i bought an item from a seller loated in NSW
waited and waited but it didnt come
finally tracking says 'not known at address returned to sender'
well i know my postlady well and this item sure never came here.
so i contact the seller advising them of the situation
a couple of days pass and i get a message my items been delivered
really? no of course it hadnt.
so i check the tracking and yes, it had been delivered TO AN ADDRESS IN NSW!
so once again i contact the seller explaining it was not delivered to me (i live in south australia)
a couple of days pass and the seller sends me a poorly worded reply (english is not his best language)
complete with a copy of the delivery information
telling me i should visit my neighbours and local post office
i write back and say 'how about you check my address in south australia
then see you sent it to the wrong address
but i get ignored
so finally i contacted ebay about it and after looking into it the agent advised me to open a INR case
which i have done
i also wrote to the seller again pointing out he sent it to the wrong address
and to please refund me
to which i get the same message 'we send it it delivered, here is the tracking'
i know i'll get my money back but geeze, hes going to have to refund so why make me any angrier
hes going to get honest feedback now for sure

Tippy,
The seller has an obligation to ensure that the item was sent to an address that matches the address in the Order details. See ebay's T&C's below - I've highlightedthe relevant section for you:
When a buyer doesn't receive an item
If a buyer doesn't receive an item, the buyer needs to open an 'Item not received' request so that the seller is aware. The seller should address the buyer's concern and provide updates on the delivery of the item, tracking information, or a refund within the eBay Money Back Guarantee timelines.
If the buyer doesn't receive a response from the seller or isn't happy with their response, the buyer can ask us to step in and help. In some cases, eBay may step in without the buyer asking.
If eBay steps in, we review the information provided by the buyer and seller for evidence of successful delivery to the buyer.
Information required to prove a successful delivery is all of the following:
I'm pretty sure that, having been delivered to another state, would qualify for an INR claim.

It has happened before and it will no doubt happen again where by the tracking numbers get mixed up with the incorrect postcode.
This may be the reason in OPs case?
So the seller needs to check if that's what happened.

i have pointed out to the seller every time ive messaged him that i live in south australia and the tracking hes showing me says it was delivered to NSW
he just keeps dragging it out with silly requests that i visit my post office or my next door neighbor
the thing never came to my post office or my neighbor, its someplace in nsw!
i can hit the button to get ebay to get involved on the 4th

This was extremely helpful, I'm in the same boat now ... but how do you open an item not received when ebay says it's been delivered (just to somewhere else)

If it was delivered by AP try going to your local PO and get them to print out where it was actually delivered to and add that to your dispute, showing that it wasn't delivered to your Paypal address as it should have been. It might pay you to get onto "live chat" and appraise them of what happened before you open a dispute.
