what can I do about being blackmailed

I bought something on ebay for an advertised price with free postage. Only to get a reply from the seller stating that he had a bug and now i have to pay for postage. It has been over a month and i still do not have the product.I will not pay the extra for postage as it clearly stated free postage. i will not be held to ransom or blackmailed.

thankyou for your input. Clearly I could not name and shame the seller just yet. And I could  only gloss over a couple of points.

I'm sure we'd all be interested in the legal issues pertaining to a seller wanting more for postage and you not wanting to pay it.

 

Given that the item is in the seller's possession. And that you would have to demonstrate material loss to get a court interested. Which a few bucks extra for postage, and/or not getting the item, would be unlikely to entail.

I think you might have been watching to many TV shows.  (No Offence)   But at the very best all you have is a civil case against the seller,  and one which you would quite likely lose and end up costing you plenty of money.

To gutterpunkz, the use of the word "blackmail" has not been misused here, one of the meanings is "to cause loss to another unless a demand is met" which is clearly the case. The Op has come here for advice not to be torn to shreds and ridiculed.  If you didn't like the question then you didn't have to answer, no one made you the Forum police or an expert on English, and even if you were, you have no right to be critical of someone else who has come here for advice.  You may not feel the distress that belongs to another because you are not travelling in their shoes. Have a little compassion. This sort of tear down is what I experienced when I first came to these boards, and I did not come back for a very long time.  There are those on here who wish to help others. Leave it up to them to answer questions.

So, the seller just did nothing when you advised that you wouldn't be paying the additional cost? i.e. No refund, no cancellation, just retained the funds?

 

Weird, as they would have known that strategy wouldn't work in the long run when someone is clearly not going to accept a change in terms. It also seems a pretty odd selling strategy to intentionally leave off postage costs and ask for more after the fact... I mean, maybe a seller might try it once or twice, but it would become very clear rather quickly it's not a wise strategy to repeat long-term. Maybe your seller had malicious intent, but logic dictates it's not a given (I mean from the outset, not with regards to retaining the payment) - especially as you subsequently wondered how many other buyers had been "duped", because if they'd pulled this a lot, feedback usually tells the story (or stories). I did have one seller tell me that paying extra for insurance was required (it didn't say so on the listing I bought from, but it did say it on all the others I looked at, so I figured it was left off in error. Unfortunately, the extra they wanted meant the price was no longer feasible, so I told them I wouldn't pay it so to please cancel and refund. I had to contact them a couple of days later because they still hadn't done it, but I wouldn't have waited any longer than that. 

 

For what it's worth, though, it's not like errors can't occur - they in fact happen all the time. Sometimes it's human error, sometimes it's software error (eg no idea whether your seller is a casual seller and made a bad choice or a mistake, or a business seller with thousands of sales, but there's a lot of software out there that syncs with eBay and automatically update listings - it's not unheard of for those updates to make erroneous changes. A while back, I spotted a seller with a whole heap of DVDs I was interested in listed at $1 free post. First thought was "awesome" and I made a couple of purchases, second thought was "hold up, that doesn't seem right...", so I contacted them and asked if the prices were genuine. They explained it was a syncing error, cancelled and refunded - no harm, no foul. Got a glowing positive from me, for the great communication and swift action, but they got a bunch of negs from others. ๐Ÿ˜• )

 

Sellers obviously don't have the right to retain funds, that's particularly bad if it's been over a month, but they do have a right to withdraw an item from sale if it has been incorrectly advertised (in other words, you don't have the right to demand it for the advertised price - these are consumer laws, not my opinion).

Plus recently there have been numerous problems and errors with  postage in ebay listings, mainly relating to multiple item listings, with postage not being added for additional items and/or miscalculated.  As the Saying goes  #it happens.

NOW  FOR THE OP.    If you are truly seeking a solution, your item has not been cancelled  and/or you are still able to contact

the seller.  Let us know the value of postage in dispute, as long as you dont live in outer whoop whoop.  I may be able to solve your

problem with a bit of magic.

Basically, if you buy something at an advertised price, the seller can't go and demand extra postage. Well, they can try but you don't have to pay it. If there has been a mistake, the seller should have cancelled & refunded you once it became clear you weren't interested in paying the extra.

 

It doesn't really matter if that extra was $2 or $20, if the sale isn't going ahead the seller needed to refund you. Very bad form for them to have done nothing in a month.

 

If something has gone wrong with your ebay claim or you find you're over the time limit to make the claim, you can try paypal.

 

Don't give up on ebay though, there are still plenty of good sellers out there.
