I was reading up on this today, as the trial started Monday.

The senior Baden Clay was on the stand today and gave evidence about something his wife told him about his daughter in law..................................I thought they usually objected and called that heresay?

Don't they do that in Australia? have I watched too many American crime shows?

Yes, the 3 children have to go through life now, knowing that their father killed their mother, how sad for them, and they are only very young.

 

Very sad too for Allisons parents and family.

About appeals, I posted this in the other thread. What could he claim for ' the court made a mistake that resulted in your conviction' ?
I am sure they will come up with something though.

Criminal cases

"If you are found guilty, you can apply for permission to appeal if you think your sentence was too harsh or the court made a mistake that resulted in your conviction.

You cannot just claim that the court was wrong because it didn’t believe your story.

If your appeal against the conviction is successful, the court will either order a new trial with a different judge and jury or find you not guilty. If your appeal against the harsh sentence is successful, the court may reduce the sentence or impose a different sentence."

The children may not want to see his family, well not yet anyway. It is going to take them along time to come to terms with what their father did to their mother.

I guess they will need alot of councelling, to get through it all..........I feel so very sad for them.

 

As for the appeal, why should he even attempt one, as he has no grounds for one.

of course he is going to appeal, he has nothing to lose, they can't increase his sentence, he already got the mximum, but there is a chance he might get it reduced on appeal.

I find a handing down of a 'guilty of murder' verdict based on circumstantial evidence most unnerving.

My thoughts and prayers go out to all family and friends involved.

I just read that the scratches on his face did it..........as he shaved to cover them up.

 

The police also sought help for overseas experts in murder cases.

 

Then there was the plants in her hair, 4 of them were found at their home and only 2 at the creek.

The mandatory minimum for non-parole period for murder is 15 years (at the time GBC was charged, now 20 years), less the time already served. There is no way that can be reduced.

Being convicted of murder in Australia on circumstantial evidence happens..even when the body is never found.
