Car accident - my fault - but witness disagrees.

I had an accident this morning.

I was swinging into a car park, misjudged and hit the rear right hand corner ute tray with the left front of my car.

Totally my fault, as far as I am concerned.

Talked to the ute driver, who was lovely, exchanged details. No issues. He bent out the but of his ute tray I hit & said no worries, no damage to his car (like I said, he was really nice).

As I was walking back to my (pretty damaged) car, a man approached me & told me to photograph the ute as it wasn't parked within the parking lines, so therefore not my fault.

I had already taken photos.

But I'm pretty sure that's not true. I haven't rung the insurance company yet, as I'm pretty upset.

Does it make a difference as to if the other driver is illegally parked? Technically, I hit a stationary vehicle. Isn't it still my fault?

Anyone have any ideas?

Are you sure there is such a law, one that says a car must be within marked  lines in a parking lot? I once got a ticket for driving with my high beams (low beems didn't work) when it came down to court, they couldn't find a law that says i have to go to low beams when an oncoming car approc.hes. I'ts only comon curtiosy i guess so as not to blind the other driver, Dismissed the case, I only took it to court because i thought the fine was exessive, i was expecting to wittle it down at best.

Really super*nova?  How did you think that?  I was simply interested in why a man would think I wasn't to blame.

 

Were the statements such as:

 

"Car accident - my fault - but witness disagrees."

"Technically, I hit a stationary vehicle. Isn't it still my fault?"

"But yes, I still hit the car, and take full responsibility for that.  Totally my error."

"I clearly stated that since I hit a stationary car, I believed it was my fault."

 

I'm not sure where you think I posted that I wasn't at fault.

 

I made is crystal clear in each post that I felt it was my fault.

 

I've read your posts, and it seems to me you enjoy trying to stir up trouble and get people to react in a negative way.

soft-tail joanie - no idea if it's a law or a road rule.  Simply repeating what the insurance company said.

 

I know to get my license I had to be parked within the white lines, that's as far as my parking knowledge goes.

 

I made a misjudgement when parking, it sucks, but accidents happen. That's why they're called accidents.

I believe English is not super's first language and probably didn't mean it literally in those chosen words.

Super is a regular and very helpful to many, so no doubt a misunderstanding.

 

I concur with others, you are in charge of your motor vehicle and need to avoid unexpected hazards. 

The ute driver could be cited for not parking properly but not responsible for the accident.

A bus hit me once when I was parked and Driver said I was over the line.

The insurance company said that does not matter you hit a parked car and you are in the wrong 🙂

Is the truck parked like that because it was too big for 1 space?

You can use 2 spaces when you have a trailer, so I suppose you can use 4 if you don't fit and it doesn't have a sign saying you can't.

I say your responsibility, as you thought, because he was stationary.

Things people do with there cars speaks volumes about them.

 

I'll park in a parking spot and walk to the store, while some schmuck parks in the fire lane right in front of the store. I see it all the time, yet never see them get tickets.

 

Taking more than one spot....it bugs me. If you can't manage the size of a car, buy a smaller one!

 

I like what this person did with chalk.....(Warning....mild curse word)
