A TEXAS judge has sentenced a confessed rapist to just five years’ probation, implying his 14-year-old victim was promiscuous and “wasn’t the victim she claimed to be”.
Sir Young, 20, pleaded guilty to raping the girl at their Booker T. Washington High School in Dallas when he was 18, even as she told him “no” and “stop”, according to the Dallas News .
But State District Judge Jeanine Howard stunned many when she opted for probation, which will include 45 days in jail, and also exempted him from standard sex-offender restrictions, such as staying away from children, attending sex offender treatment, undergoing a sex offender evaluation or refraining from watching pornography.
Howard told the News she made her decision partly because medical records showed the victim had had three sexual partners and had given birth to a baby — both claims the girl has denied.
“She wasn’t the victim she claimed to be,” Howard said. “He is not your typical sex offender.
Did the judge get it right?

Okay, rape of a child. imo, is more severe than the rape of an adult, however, that doesn't minimise the impact that rape has on adult victims. It is an abhorrent act and not a competition.

You really find it impossible to believe that a middle aged, middle class, American woman, educated at Southern Methodist University, and Texas Christian University, a member fo the Thomas More Society (a society for Catholic Lawyers) and a mother of two daughters, might just be slightly prejudiced against a promiscuous 14 year old girl.?

not arguing with ya she ele, it's just my opinion.
but i would have thought a catholic with twio daughters would be even more ihnclined to favour the girl, lawyer or not.

Judges make mistakes from time to time but the consequences can be pretty horrible. Look at JIll Meagher's killer for example or Sarah Cafferky's killer. And,ofcourse, that judge that declared that there was no such thing as rape in marriage shouldn't be forgotten.

I have a 14 year old daughter of my own, so i know the repulsion I would feel for anyone who harmed her and would find it difficult to sympathise with anyone, so I can't help but think this judge would feel similarly if she were to allow her own prejudices to determine the outcome for the csase.
A few years ago, a man who i communicated with, but at that stage didn't know all that well, commented on how beautiful my daughter was. The first time i just thought it an awkward and clumsy but attempted polite response (after all polite society doesn't permit us to say someone's kid is ugly) but nonetheless, the comment had me on alert.
They later again commented on ho0w beautiful my daughter was, and it really creeped me out.
In the time since, I got to know the person very well, and I don't think they meant it in a creepy way, but I can't help thinking about it, even now, and they'll never ever get anywhere near my daughter, just in case. But I have no other reason to believe they might :like' little girls, but that comment....
but I cannot allow that prejudice or perception to cloud my judgement when it is facts on which I must base my decisions as is the case with a judge.

I think that's a major factor i.e the impact that rape has on the victim.

Is there a time when Rape is not as bad?
Yes....when the offender is getting the same treatment in prison.

I agree, and let's not forget that there are physiological changes that take place in a woman's body, when she is a willing partner anticipating intercourse, that do not take place when she is raped. Pain and physical damage can be considerable when intercourse is forced.

Do you think that rape in prison is less serious Jimmeh?
What about an 18yr old boy that just didn't know when to stop when the girl was initially very interested?
