I also wonder exactly what his penalty will be, given no physical crime had been committed. Obviously there will be charges of keeping pornography, conspiring to commit acts I suppose. But I don't see a lengthy term for him, certainly not what he deserves.

Judges and magistrates decide according to guidelines of the law.  They do not make it up as they go.  Getting bail does not mean he will not be convicted, and just possessing child porn carries custodial sentence.  So I would imagine he will spend some time in the jail.  Obviously, he will not be allowed near his baby or any other child while waiting for his trial, and his passport would be confiscated.
