But Donna they are unlawfully in the country regardless of what their refugee status is until they have been approved for refugee status and issued proper documentation. Till that time they are here illegally.

OK. Forget justifications. They are referring to those who arrive here without authorisation by correct terminology ie illegal arrivals, unlawful arrivals, unauthorised arrivals. It is why those people who enter another country without authorisation are detained for determining the purpose of illegal, unlawful, unauthorised entry.
