Unfair Dismissal

A friends Granddaughter was working for a large retail store.

Last Thursday when she knocking off she was at a checkout paying for something she was buying when a customer complained that she and the checkout operator were not working but just talking.

On friday when she arrived at work she was called into her supervisors office and after a short conversation she was sacked on the spot.

This was the first time she had been in trouble.

Grandmoon - can you answer my questions please?

How many days a week does she work?

Do you know the exact reason they gave her for letting her go - either due to her poor performance/attitude or they were shedding staff due to lack of sales or similar?

I am pretty sure an employer would not sack an employee after 1 customer complaint against them if their work record had been perfect prior to this.. there has to be more to it than that.

Employer has been hung and quartered by the CS jury.. that must mean they were in the wrong, right?

Does sacked on the spot mean, no notice was given?

Are you 100% sure she is not a permanent casual OP?

Do you know how many days a week she regularly rostered on for?

How much notice do I give staff?

Notice of termination is part of the National Employment Standards (NES).

Under the NES, if an employer terminates the employment of a permanent employee, they must provide the following notice:

Period of continuous service

Notice period

Not more than 1 year -  1 weeks notice

More than 1 year, but not more than 3 years -  2 weeks notice
