VCAT & Vic Ombudsman COVER UP the Dept of Housing's Maladministration &Corruption -NO Govt Integrity

Dear All, 

My family and I are shocked by the level of Corruption & Misconduct within Victorian Government Departments (Dept of Housing , Victorian Ombudsman and VCAT). My family and I are very good Public Tenants (my Son has a disability Autism) but since our very valid complaints against Two Dept of Housing Problem Managers, we are experiencing discrimination, Maladministration and reduction in essential services by the Dept of Housing. The manner in which the Victorian Ombudsman and VCAT Mishandle our complaints is nothing short of Appalling Misconduct and Corruption. We are uncovering a deepset Lack of Integrity, Lack of Accountability and Lack of Transparency within each of these Government Departments, Laws need to be changed to Protect Public Housing Tenants but Also the General Public.

It is the job of Victorian Ombudsman to make the Dept of Housing staff accountable for their actions, but they have done nothing to resolve our complaints

 

  • Dept of Housing are Discriminating against us and have stopped sending Automatic Rental Statements. Their policy states that Tenants are to receive statements every three months.
  • Dept of Housing Refuse to send us an Account Reconciliation despite our numerous requests,which is also against their Tenancy Management Manual.
  • Dept of Housing Breach the Residential Tenancies Act by Not maintaining our premises in good repair, No programmed works in Fifteen Years and also (leaving a 24 year old window lock faulty and unsafe (we had to replace it, and VCAT ordered Dept of Housing Reimburse us and 5 years later Dept have Not reimbursed us, leaving an old gas stove faulty (unsafe) and not servicing in 5 years, not repairing Storm damages in Years, ETC.
  • Rude and Confrontational Dept of Housing Staff
  • There are more complaints but they will exceed this page.

Until The Victorian Ombudsman Act 1973 is corrected, Vic Ombudsman staff will not bother to do their jobs properly. A report (full of errors) came back from a "Junior officer" at the Ombudsman office who stated she will not investigate our complaints. She got all the facts wrong. We escalated this to her manager who replied "Sorry but we have limited resources" The Law states that the Victorian Ombudsman decides whether to make enquiries or investigate complaints (two different things), when we ask for the details of the responses by the Dept of Housing to the Vic Ombudsman, the Vic Ombudsman refuse to provide this information as they state that the Victorian Ombudsman are not subject to Freedom of Information. So where is Transparency to allow us to correct Department of Housing Inaccuracies and Misleading Statements???

 

As for VCAT, from our experience they take the Cake for Misconduct and Corruption. In our last Tenants Application to VCAT against the Department of Housing, Senior Member completely Left Out of the Final Written Reasons all the repairs that the Dept of Housing were Requested to do by Consumer Affairs, also VCAT Senior Member convenientely left out most of our vital evidence, he also made numerous Errors for eg "Big hole in the roof finally filled after days instead of Three and a Half Years".

 

Our Family again have taken the Dept of Housing to VCAT but we are currently experiencing, Biased Members which we requested be Disqualified, also No fair hearing, No impartiality and gross Misconduct. VCAT have Prevented Three persons we Summoned into VCAT which is vital evidence to our case (One being the Junior Vic Ombudsman Officer who made nothing but errors in her report).   All the Best to you All.     mariem888

The Director of Housing, Victorian Ombudsman and V/CAT are all Government Departments at the end of the day.

 

It's clear to us that VCAT and Vic.Ombudsman Don't want to accurately record or document the Maladministration and Misconduct of another Government Department (the Dept.of Housing)Two problem Managers. If the facts were truthfully reported by the agencies then it would Not reflect well on the Dept.of Housing Management. 

 

Ever since our complaints about these two Managers to the Dept.of Housing, we are experiencing Discrimination which is Disadvantaging our Family.

 

They can boast all they like about having integrity, but we have identified some Deeply set problems with these organisations, from our experiences they Don't follow proper Complaint Handling processes. What started as our straight forward simple and reasonable requests to Reinstate our Essential Services has snowballed to this stage to involve other Government Agencies.

 

The Dept.of Housing two problem Managers are wasting government time, money and resources as well as inconveniencing our Family.

I find it hard to believe that the whole world is against you; the VCAT and ombudsman do not cover up.  Why would the department waste time and money having to front up to VCAT and ombudsman instead of just replacing the stove?  Maybe they consider that some of the damage was cause by you and it is up to you to fix? 

 

By all means, go to the media, but be very careful because they will also look at the facts as presented by all sides, and in the end might take the Housing Commission's side.

***I will begin by referring to Actual Case Law*** 

 

A Landmark Decision by the Supreme Court in 2014 Case found that Director of Housing Staff did NOT follow their own Tenancy Management Manual Policies Nor the appropriate Human Rights Charter Laws at the great disadvantage to those particular Public Tenants.

The Supreme Court also found VCAT's decision to be Wrong on a Question of Law, VCAT's decision was Overturned.

 

A decision that V/Cat Should have made in favour of the Tenants needed to be taken to the Supreme Court to find Justice.

 

Lets put the debate to rest and make the facts quite clear, we Tenants have had No choice but to Summon the Director of Housing in Our Tenants Application to V/Cat Five years ago (Four Hearings in same case, V/Cat used two File Numbers to Dilute our Application Case and there were two Biased Senior Members all same case Five years ago, first one Ordered the Dept.of Housing to carry out the Consumer Affairs repairs 2011 report Storm damages and such which are INSURED and would Not have cost the Dept.of Housing a Cent, Yet this Consumer Affairs 2011 Order (Even though the Senior Member said that we knew our Case well), Consumer Affairs 2011 Order was Completely Left out of the Final V/Cat Written reasons and also our Vital evidence and Videos, and our Facts were completely Misinterpreted by the Biased Member example he stated Gaping Hole finally filled after days instead of Three and Half Years. Also these Members Don’t allow you to Question the Dept.of Housing staff, and also suppressed our S.E.S. evidence and Our Roof Plumbers report evidence V/Cat taps the Director on the hand and stated the Director of Housing could have done things better.

 

Now in our NEW Tenants Application to V/Cat case for Maladministration of the Director of Housing and also Reduction in ALL Essential Services Director breaching RTA Laws 43 and 45, 67, 68 and Many others. V/Cat on three occassion have tried to keep our submissions out of our V/cat file so the presiding member cant read them.

 

This Reduction in ALL services has occurred after we made Complaints to Vic.Ombudsman about two problem Managers first one for taking Thirty Six Weeks to assess our Rental Rebate application instead of the normal two weeks. and we also made a complaint to Vic.Ombudsman about another Manager, alos because We Took the Director of Housing to V/Cat Five Years ago, they have both found any opportunity to make our lives difficult, example of Reduction in All Services, No Automatic Rental Statements, Refusing to provide a Rental Account Reconciliation Never received, No responses to our Rental queries example," has the Dept.of Housing increased our weekly Rental"? No responses from anyone keeping us in the dark.

 

No Programmed works in Fifteen Years which means Carpets Fifteen Years old and worn, No interior or exterior painting, etc. Our Plumber confirms the fifteen year Old rusted stove had Multiple Faults which we reported to the Dept.of Housing and to V/Cat FIVE years ago at the SITE hearing we pointed out to the Senior Member and to the Dept.of Housing standing there "Look when we turn on an element the flames on the other ones Reduce Low etc. which took longer to do our cooking, BUT the Senior Member swept this aside and said that the Dept.of Housing Plumber serviced the Gas Stove in June,2011, FAST TRACK Five years to CURRENT Day and we have Our Plumbers Report which describes the Multiple Faults that the fifteen Year old Gas Stove had when one element turned on the other goes off, our Plumbers report also found that there were Two Kinked Stove Gas copper floor pipe and kinked oven hose at the back of the oven which the Dept.of Housing plumber would have noticed Five Years ago but did Nothing, also signs of overheating on side of old stove so we replaced both Multiple Faults Old Toilet and Old Multiple faults Gas stove and we have requested and are waiting for Reimbursement from the Director.

 

**VCAT have also have decided to place the very Same Biased Corrupt Senior Member on our New Tenants Application Case which we have requested Recuse Disqualify himself for being Biased yet he wants to remain on the case.

 

**By the way, On Three occasions now VCAT have found excuses NOT to place our NEW Tenants Application to VCAT Submissions (Six Handwritten Letters) All Forms Centrelink letter Etc from our File Preventing the presiding Member from reading our Submissions which include all the Facts and they are aware we have Photos and Videos.

 

What you have written in your reply proves you know Nothing about our NEW Tenants Application to V/Cat case against the Director of Housing for Maladministration and Reduction in ALL Essential Services breaching RTA Laws 43 and 45 as well as many others.

 

Your vague statement regarding VCAT and Vic Ombudsman is unsubstantiated and has No substance. Have you personally overseen each of the Thousands of cases handled by these agencies? We doubt that.

It's been mentioned earlier - why are you still in public housing

after 22 years?

 

And if it's this much trouble, for so long,  why would you stay?

 

Plenty of people on benefits that I know, can manage private rental,

and have done so for many years.

People can't help circumstances for instance being elderly and having a Son with a Disability Autism who also has a serious Health condition. You don't know our personal circumstances, your suggestion is offensive, inappropriate and inconsiderate.

You weren't elderly 22 years ago.   Like I said, I've known worse cases

who've been able to rent privately.

 

I had an opinion, and I gave it.

 

Why post here, of all places?  Go to the media if you're so sure of your facts.

OMG!  I just realised that my gas stove must about 30 years old!  Well, we bought this house almost 20 years ago, and it was rather old then.  It was on my list of things to do, but over the years it slid down the page  🙂  It still works well.  What is a normal life span of stoves?

I doubt many people have read all the ramblings anyway.

 

When such long rantings are posted, people tend to switch off,

If you do go to the media I hope you are prepared for them to make you look a complete bogan.

They typically do this when people in Public Housing etc contact them.

I am in Public Housing and on the rare occasions I have needed repairs have had to wait no more than a week....perhaps the problem is you...not the Dept.
