The New York City Police Department said a man driving a Range Rover with his wife and 2-year-old daughter inside Sunday struck a motorcyclist on Manhattan's West Side Highway, breaking his leg.

 

The SUV driver pulled over, and the bikers surrounded his vehicle, hitting it and spiking the tires, police said. The driver pulled away, hitting three more bikers in the process, police said.

 

Should the driver in the SUV be charged?

I said yes, he should. (should is a normative statement)

 

I don't believe it is up to the police officer to decide whether a person should be charged or not. If a law is broken, then yes, they should be charged. Then the court should take all relevant factors into consideration and make the relevant decision.

 

Last time I checked, it is illegal to run someone over with your car. It is illegal to cause harm to another person and it is illegal to cause harm to someone else's property. Even if we think they deserve it.


in the U.S. where this happened they have self defense and reasonable use of force laws.

My understanding is in these cases the police take the info to the prosecuters and the prosecuters decide if they are to charge people or not.

In this case the police had very little work to do as one thug genius provided them with all the evidence they needed, plus a lot more by posting the videos.

I understand that you think he should be charged and then a court should decide whether he is guilty or not and the police shouldn't be making that decision.
However police officers have to make the decision whether a person has committed an offence according to the law. They can't just collect up everyone who may possibly have broken a law to keep courts full and lawyers employed.

If it's not clear if a crime was commited the cops will take a report and the district attorney will decide. If he or she thinks so they might have a grand jury decide. It's like a mini trial to see it if should go before an actual jury.

 

I think the SUV driver should be charged with assault with a deadly weapon.

 

From what I hear....the bikers were blocking entrance ramps to the highway to create a caravan of bikers. The SUV driver didn't want to wait and drove around the guy blocking (knocking him down, hitting him? Not sure). What you see in the video is what took place after.

 

I'd be willing to bet....if when stopped the SUV may have got a few dings...nothing more. The driver did what he did out of anger, not because he was scared. Considering he had his wife and kid...he should have waited. I see the way people drive here and I'll bet $ ONE MILLION DOLLARS the SUV driver started it!

 

I know they shouldn't have been blocking entrances to the highway, but so what....one of the bikers is reported to be paralyzed.

 

Mayor bloomburg is a stuffed shirt and bikers don't have enough voting base to carry weight with him. They have west indian day parade, Puerto Rican day parade, etc.....and 9 out 10 times there are shootings, stabbings and robberies, riots. But they have a lot of voters!

 

In other cities....the safest time of year is bike week. Try snatching a purse in front of a group of bikers....aint gonna happen. Although these aren't real bikers....they were weekend warriors and wanna be's.

Joe you need to do a little reasearch on the difference between AWD and 4WD systems, I always thought you knew a lot about cars

Time will tell Hawk. No matter what happened...both are at fault. But seeing the SUV drive right over the guy.....it's not like one if them pulled a gun on him.

 

Monday I had a rare sighting of an H.A. Not usually seen wearing their colours.

 

My comment about bloomburg....the point was he should have approved the gathering and been given an escort....like all other groups. It's only once a year....and last year went pretty smooth. (maybe a few minor incidents.....nothing as bad as the others though)

 

I'm not sure of the difference either. My sisters SUV has the option for 4 or 2 wheel drive. But if she wanted to go "bush bashing" (LOL)....it would need some modifications (beefed up suspension, shocks, springs, tires).

I'm glad you clarified your comment about Bloomberg because I was puzzling over where that fitted in. As he didn't however, does that justify the bikers grouping and blocking traffic in the first place?

Jimmeh I been on a number of large runs now, and the only ones that have ever had police interest or escorts are when the 1% clubs have their runs.

My question to you was based on your comment about running the guy over because he blocked the road for a minute so the group stayed together and if you thought that justified runimg over someone
