Talk about red tape......

 

OH is still in Hospital....they've changed his insulin regime AGAIN....BSL's are between 6 and shoot  up to 15-18 at night.  They wont release him till he stabilises....and he's going into a respite centre owned by the hospital ....he can stay there for up to 12 weeks.

ACAT   are going to assess him when he's in hospital or the respite centre.  I have to find his Power of Attorney POA before I can book him into an Aged Care home....I can't find it at the moment so that's another stress I don't need.

Gill you can get a copy of the POA from the solicitor where you drew it up so shouldnt be too much of a biggie for you

 

So much to do girl but all of a sudden things start falling into place try and stay strong not easy:(

Unfortunately, to add to everything....the solicitor that drew it up moved to Texas US soon after drawing it up....can't even remember her name....Aussi solicitors are in great demand in the US apparently.

However I have my nephew who is a surveyor, doing a search for me through one of his contacts.  So hoping for the best there.

That is good then, the respite, for both of you ๐Ÿ™‚ They will be able to assess his care needs too. Don't stress over the POA, it will be there. Just have a rest and enjoy the break from the responsibility, did you also have an enduring guardianship? for his health care? it may be that is all you need for now, as his POA is for financial purposes.

Gill, the original POA should be with the solicitor, not a copy.  And you do need to have the original in order to put it into use.

When my father went into hospital his POA was activated using the copy he had at home...there were solicitors letters flying all over the place because his bank had accepted a copy not the original which was still in the solicitor's office.

 

Your solicitor would not have been able to take those papers out of the country....they should still be here in Australia.  Did she work for/with other solicitors?  If so, contact them as your documents should be there still.   If not, ring the Law Association and ask where the documents should be.

Lyndal has a good point there.. assuming  the solicitor who drew up the POA, didn't work for themselves.. can you phone the firm she worked for and ask about getting your OH's POA.

 

If a solicitor leaves a law firm, they don't take their clients details/files with them, those clients belong to the firm. My father was required to attend a court case once,  his lawyer left a firm, set up on his own and took the files of the clients he worked with (my Dad being one of them). The firm took the lawyer to court.

The copy of the POA that Dad had at home was signed and witnessed exactly the same as the original but my solicitor was adamant that it should not be used when activating the POA.   There was quite a fuss in the bank when it was pointed out that they had accepted a copy POA....and they allowed it to be used after my dad had died.
