Hi all, story goes, sent reminder on day 5 to buyer, opened UPI day 7, buyer paid day 8, case closed. A week later we receive negative: Great item SHOCKING SELLER IMPATIENT DEMAND PMT - NOT DEAL AGAIN


Goes witout saying that no feedback has or will be left for this buyer and have put on our BBL


 


eBay states 4 days can open UPI, close 4 days later if no payment.


 


Should we ask eBay to remove fb on the grounds that we were following eBay protocol?? Bit cheesed off actually, 8+ years and first ever neg!

tut tut rabbit, now that would be telling and I have seen enough on here to know it is most prudent to keep a sellers id a long way from the boards

Yes, contact ebay, if you don't try, you won't know.


 


In these cases I always make a point of sending a special email (via ebay's messaging system),  thanking them for payment and letting them know I will be posting shortly.


 


Would be nice to be able to add this seller to BBL, not a nice buyer - thankfully 99% of buyers are fabulous, otherwise we wouldn't be here.

Mst definitely FJ, contact eBay and have the feedback removed. It is a sellers right to open a dispute after four days.

Always amazes me how some buyers take an unpaid item case as a personal insult. If they just paid their bills without being reminded then there wouldn't be a problem.


 


Maybe you should call the buyer and ask if they would revise the feedback. Might be worth a try.

Thanks, yes we always message thru the eBay system, and my reminder was even worded that I would accept mutual cancellation if there was a (legitimate) problem, no reply. Will phone eBay Monday, thanks all, didn't know if we were over reacting to our first neg or if it was as unfair as I thought

I think it is really unfair, I think you could contact eBay today? Pretty sure it is 24/7, but someone else will correct me if I ma wrong, good luck with it flotsam




Yes I agree - try and contact eBay today as it is unfair.



If ebay won't remove it I think you will find if you lodge a defamation claim form it will be gone.

on what grounds?  The buyer felt the seller was impatient (rightly or wrongly) and said so in a feedback comment.  Feedback is the buyers perspective of the transaction.


 


I'm not saying the feedback was justified, but I don't think it is defamatory.  It is not nice, nasty in fact, but not defamatory.


 


Perhaps a followup comment would be appropriate.  Something along lines of "guilty! buyer ignores msgs, only pays when UPI case opened ON DAY 7, I'm impatient?"

Yes feedback is the buyers perspective of a transaction but to make comments which damages the reputation of a person or business can be seen as false and defamatory.



The seller was not impatient, they did not demand payment and if it is the first negative feedback they ever received then they can't be a shocking seller either.



It is defamatory to their reputation for honesty and integrity as it could cause ordinary, reasonable persons (eBay buyers) to think less of the seller or shun or avoid their products for sale on eBay
