hi,
A buyer asked me in November last year to cancel the sale after winning an auction. I cancelled the sale.
then in Jan this year left me negative feedback saying item not received??!!
Ebay refused to remove it as they said it was an opinion?! based on what ?? not receiving an item you didnt pay for ?? can anyone HAVE an opinion about that ?
How is this fair or ethical ?
I realise the changes to the feedback system over the last few years has had a lot of comments re right & wrong but surely this takes the cake!

Seems unfair to me too.
I would keep contacting ebay to get what appears to be an unfair neg removed.
Also, I noticed this same buyer left a neutral for you in November last year. Why on earth didn't you block them and prevent then from buying of you again, all the warning signs were there.
Hope you have done so now.

It was your choice to offer them a mutual cancellation instead of telling them to pay up or get the unpaid item strike they deserved (putting it more politely of course)
Had you done that and they didn't pay you would have got your FVF refunded, the buyer would have got a strike which is important as it helps protect all sellers from non paying numpties and the wouldn't have been able to leave any feedback.
Did you actually call ebay and tell them that they should be able to see from the ebay messages that the buyer requested the item be cancelled so how is it fair that they can leave feedback although you have probably left it too long.
I think you need to worry more about your DSRs and your keyword spamming, now that you have brought your listings to the attention of the button pushers you may be in for a few policy violations.

Call ebay back and tell them to read the message from that buyer requesting to cancel the sale.
They should remove it as the buyer requested it.
If they don't then call again till you get someone that will.
Call them do not email them.

The problem with the Ebay system as it stands right now regarding feedback is that it hounds buyers into leaving feedback, even if the sale is cancelled by mutual agreement, and very often the 'Would be' buyer has no idea how to get Ebay off their backs, so they tend to leave a feedback that doesn't give a true representation of the facts, as in your situation I believe.
More than likely the buyer wasn't thinking about how it might affect you as a seller when they left the feedback, but still felt they were telling the truth because they DIDN'T ever receive the item because they couldn't do after the cancelation.
I think it's time that Ebay thought things through far better regarding feedback so they remove the feedback section on any items where the sale has been cancelled out for whatever reason.
That way the buyer wouldn't keep having the Ebay prompts to leave feedback as they do now.
I have had the same thing happen to me in the past with Ebay telling me to leave feedback for items that were cancelled by mutual consent but I get around it by leaving a positive feedback while saying "Transaction cancelled", but that's because I know I'll be doing future business with that seller and don't want to cause them problems.
However, no doubt that the buyer in your case knows they are unlikely to ever deal with you again so they aren't thinking about how their feedback affects you.

Sorry, I hit the 'Post' button before I'd finished my reply. Senior moment lol.
I was going to suggest that you contact the buyer and ask them if they would be willing to review their feedback after explaining the situation to them clearly.
I think that if you approach them in a polite and friendly way they might well be willing to change things if you send them the Ebay feedback Review request.
I know I would in such a situation if I were approached nicely, but that's just me.

Hi OP, asking the s..t for brains who left the f/back to change it is a waste of time in 99% of the cases.
Not only that, but there is something awfully wrong with Ebay telling us to plead and appeal to the very person who did the deed, while really it's their job to remove the negs given for no sale, no matter who did the cancelling or not paying or whatever.
No reason on Earth why would anyone have to be inconvenienced due their poor web design, not thinking of removing the possibility of any f/back.
That is what I would do if I wanted to have my job easier, and not have members ringing up all day long creating more work for the staff removing the unjust negs.
I would just remove the ability to leave any f/back - end of story.

Just had a look at the buyers feedback left for others, definitely one for the BBL. Agree with JHOS, don't think you'd have much luck with a revision request. If eBay don't remove the neg then fill out the standard eBay defamation form and it will be removed promptly.

Yes, I can see things clearly, and I was making my comment with tongue in cheek and joking.
Believe me when I tell you that I have a tendancy to call a spade a shovel and talk very straight, but these message boards are so tightly monitored you can't even fart without receiving a repremand for it from some silly moderator out to make a name for themselves.
There's no angels in my world, buyers or sellers, but sometimes it pays to point out things to the SFBs in a nice way.
My selling motto has always been, "The customer is always right, even if they are the biggest PITA in the world" and it's given me a respected business name for over 40 years now.
I just don't voice my motto to the customer lol.
