Buyer not wanting item

I am new to ebay and I sold some pjs tonight.  I advertised that they were girls size 14.  They were from the kids brand Justice which is a children's clothing company.  I even mentioned my daughter in the description.  Now the buyer is saying she thought they were adults size 14 not kids and doesn't want to pay.  She is asking me to re-list.  What should I do?

It rather depends on the terms of your Returns Policy as described in your sales listing for the item.

 

When I list items I say that I will agree to a return and refund (or as in this case, a cancellation of the sale) if there was a mistake in the listing or the item was somehow misrepresented.

 

However, if the winning bidder just simply misread your accurate description in the listing, that in my book, is not really grounds for a cancellation of her purchase from you.

 

Having said all that, if you refuse to cancel the listing and make it known to the buyer that you still expect payment, you run the risk of receiving negative feedback from them, despite the fact that ebay describe sales transactions as 'binding contracts' that should be honoured by both buyers and sellers.

 

You do of course have the option if you wish to continue with the transaction and pursue payment from this buyer, of waiting to see whether they decide to pay within the time you have allowed for payment and if they don't, opening an Unpaid Item Case. Again, despite your right to do this, such a course of action could attract negative feedback.

 

I guarantee that if you receive neg feedback in this situation, ebay will not see that as grounds for removing the feedback.

 

Sellers are a little over a barrel with bad buyer behaviour. We do not receive adequate support from ebay in my opinion.

You have two options here.

 

1. Send the buyer a request for a mutual cancellation which they have to agree to in order for you to get your final value fees refunded and be able to re-list the item. With a mutual cancellation both parties can still leave feedback.

 

2. Wait exactly 4 days after the sale and open an unpaid item case. After another 4 days if payment hasn't been received you must close the case - then your final value fees will be refunded, you are free to re-list and the buyer will have an unpaid item strike recorded against their account. With this method neither party is able to leave any feedback and if the buyer happens to leave you negative feedback before the case is closed then eBay will remove it.

 

To activate either of these options use the drop down menu 'More Actions' next to the sold item and select 'Resolve a Problem'.

what a horrible start to eBay for you.

 

I have looked at the listing and not only have you said they are girls pyjamas in your title, but it also says it again in your listing!

 

The person must need braille if they thought the listing was for ladies sizes.

 

at least she has told you that she doesn't want them and hasn't just strung you along.

 

but if you don't cancel the order you do risk her being unfairly angry with you and if she leaves you a negative, you are so new that it will really hurt your feedback score.

 

This woman does deserve a strike for non payment. and you can't force her to pay. (not for $7, anyway)

 

I wouldn't be kind enough to let her off the hook by offering a mutual cancellation (which if she doesn't accept BTW, you will not get your fees back.
 (but then maybe you are more kind than I am.
)

 

If it were me, I would think very hard about opening a non payment dispute in the resolution centre. This way she will either pay (but she can leave you feedback then and if she is cross at being "forced" she may neg you) or she won't and you will get your FVF's back and no feedback will be able to be left and she will get a strike.

 

If you do this, send her a message saying something like......

 

I am happy to cancel the sale for you. In order to be able to relist and get the fees back that I will be charged for this sale, I have to let eBay know that you want to cancel the sale and won't be paying, in the resolution centre. It has an awful name, but please don't be alarmed. it will be called an Unpaid Item Dispute. I will open it 4 days from when the auction finishes, and eBay will then give you another 4 days to decide if you want to change your mind and pay for the item that you bid on. If you still don't want the pyjamas, there is no need for you to do anything else. I will close the case on November 27 (?) and then eBay will allow me to relist the item and I will get a credit for the fees that I have incurred for this sale. eBay will then record a strike against your account for non payment, but don't be worried about that, strikes only matter once you get 2 of them. So it is all good!

You can't relist them until the listing has been cancelled. What a shame you have encountered such a numpty when you are so new.

One thing I would recommend if you are going to be selling clothes is that you do put their measurements in the listing, ok? (I know it wouldn't have helped much this time, but, in future it might)

As long as they were listed in the children's category there is no way I would offer mutual cancellation. I would open the dispute for non payment after 4 days and if she did pay up I would make sure I sent with signature required and if she left a neg I would find that preferable to letting her get away with not paying. She should pay and then resell them herself if they are no good to her.
