What do I do when a buyer purchases my item that is pick up only, who emails to say they will organise a courier and then opens a dispute because they have ben too busy to do this? What are my rights in this situation? I have emailed again with dates and times I am home and heard nothing again. I will not be refunding as this item has been relisted due to another buyer winning the item then arguing about it being pickup when it states quite clearly that it is PU only.

Are we talking about the Triton work station that you have received 2 lots of feedback for back in late October?
I am surprised that you have not had the police knocking on your door before now if you sold it twice.

โIf your buyer were to come to these boards & state what they've done & your refusal to refund, they'd be told to report you to Online Fraudโ.
On what basis.
The seller is not refusing to hand over the item. In fact the seller is saying, you bought it, you paid for it, itโs yours, now come and pick it up or arrange for someone to pick it up for your behalf. So whereโs the fraud.
There is a legal term for this. Itโs called specific compliance with the terms of the contract to which the buyer agreed when they entered into that contract. But there is a down side to this, in that the seller must now hold the goods until they are either collected (put it in the shed and throw tarp over it) or until the statutory period has expired, with the upside being, once the period has expired the good will be deemed abandoned, at which time seller can dispose of it any way they deem fit.

Tall-Bearded-this is from the OP so you can read that whatever way you like.I read it as refusal.
I will not be refunding

I think you missed that part of the original post where he said the โ item has been relisted due to another buyer winning the item then arguing about it being pickup when it states quite clearly that it is PU onlyโ
That is the first sale fell through because the item wasnโt paid for and the buy refused to pick it up thus requiring it be relisted.

And you missed the part of my post that suggested he open a non payer dispute etc
Gee,lot of missing stuff here ;\

But you need to read the โI will not be refundingโ it in its context of what was written
That is nothing contained in the original post or any sobriquet post by the OP could reasonably be reasonably construed to mean anything other than what I sad at Post 11

โAnd you missed the part of my post that suggested he open a non payer disputeโ
How do you open a non payer dispute when the item has already been paid for

Then we'll just have to agree to disagree ๐

Yet again, looks like you & I will have to agree to disagree as this was in OP
as this item has been relisted due to another buyer winning the item then arguing about it being pickup when it states quite clearly that it is PU only
Which reads to me that buyer didn't pay.
