I have sold a microscope to US from Australia.

I had paid insurance for handling and also agreed to pay commission for sale to eBay.

 

Three days after item was received by buyer, he requested a refund, claiming that two parts were broken in transit. I was surprised as photos showed damage that was not expected. When questioned, he provided an unpacking video, basically pretending that he is unpacking, but looked like he was just trying to take out broken pieces that he already had put in the package. Nothing falling out, not surprised.

Although showing items from a weird angel so I cannot identify them.

white dust mark was on an unpacked broken item straightforward out of plastic packaging.

zooming in, I could see the print on the eyepiece that he claimed was mine and broken did not match my photos.

on first reaction, I offered partial refund thinking that I will claim damage from eBay post insurance but also contacted eBay for help.

they said ask buyer to send you back the microscope and you’ll pay for post and you’ll be covered by eBay.

i did that too. The buyer did not answer and did not respond to partial refund offer until 11th hour and rejected it. Then eBay said you have now 5 hours to message the buyer with a label !!! ( previously I was told not to do anything and wait for buyer to respond back).

in the short time, I went on line to buy postage label, as buyer had not cooperated.

But I found out that there is no way I can purchase a label for a microscope that is categorised as medical device. It needs a permit to the buyer from US costumes.

I communicated that with eBay team again. The agent was understanding and knew US customs policies so said you just need to ask eBay to step in- don’t do anything else and our expert team will look and help.

the case was shown to be on hold for five days until eBay team finds a solution.

i was told rest assured that you are covered and buyer will be charged with this and you get a refund.

At the end of the period, I received a message that buyer was fully refunded and I have a debt to eBay for postage and commission and insurance that will be deducted from my account.

My appeal was rejected three times. Apparently they say the buyer is willing to send back the item.

I messaged him again and he said send me a sticker and I’ll put it in the box. I explained again to him that he needs to get the label on his side.

He refuses. I have paid for my microscope to be shipped to this buyer overseas where he can keep it without paying g a cent. I have to pay eBay for fees and postage and additional insurance on postage. 
Has anyone ever dealt with this issue? Can I get a logical response from eBay or they just aim to shut me down now that they think their stream lined steps are complete. 

What can I do about this situation? Should I ask for legal assistance outside eBay?

Yes, plenty of new sellers who don't know the pitfalls of sending expensive items overseas.

 

Sellers rarely win an item not as described case.

Seriously ?

 

That's what they would have told the buyer.

 

The seller  must  supply tracked return postage in an item not as described case and because you didn't, 

 

eBay stepped in on behalf of the buyer, refunded in full and closed the case.

The ebay team told me many times that I have made attempts to solve the issue and they are going to ask buyer to send the item back and be refunded. Buyers refused to do so as it was not his intention from beginning.

While so was waiting for eBay team to find a solution for this problem, they went ahead and fully refunded the buyer and left me with financial loss.

like a deaf person, eBay team members that I don’t talk to ( email or chat) keep telling me to send a label. No understanding of the US costumes laws. 
Buyer has refused to accept payment by seller and purchase a return label  himself, as he is the only person that can get permission from the costumes and sign the label.

This means that eBay has no respect for the seller rights. 
I have lost my microscope worth more than 1800 AUD, have paid for postage and also insurance for postage and on top of that 15% of my microscope’s price to eBay.

Buyer has received a microscope for free. That is unbelievable.

Horrible service by eBay.

This transaction is illegal and scammed.

Seriously? Once I read this, you lost me completely. I stopped reading immediately because your credibility just went right out the window.

 

There is absolutely no way that you could possibly know what their intention was, is, or ever could be.

Okay, maybe you can't see into a buyer's mind but you are understandably upset and we can see enough of a pattern here to suspect you have been treated badly or scammed.

 

For starters, you are a zero feedback seller. That screams newbie to a lot of buyers. They expect you may not know your way around ebay all that well and some buyers will take advantage of it.

Next, you had a very expensive item on sale. And you were allowing an overseas sale. That is always highly risky, you would be better in future (if you do use ebay in future) to limit sales to within Australia only. Much, much easier to deal with if things go wrong.

 

Then, we have your suspicion that parts of it were not in fact matching what you sent, it didn't match your photos. That's a huge red flag, right there. If you are correct, this buyer always intended to make a claim, swap his broken bits for new and then get a refund.

 

But the biggest red flag in my opinion is you have a buyer of a $1800 item who has supposedly received some parts broken, yet he doesn't respond to the offer of a partial refund and doesn't respond to your offer of a return either, till 5 hours before it closes. Dodgy.

 

As far as I know (and I am not an expert on this as I haven't sold in years) you cannot supply a postage label to someone overseas but in a return case, where a buyer says something is faulty, you'd still be expected to pay for that return. The buyer would never get charged for it by ebay.

 

Now all you can do is negotiate with the buyer privately, in that you can explain that they can find out what the postage amount would be and have you reimburse them before they send it. But that is risky too as I can't see there is any guarantee they would then send it. And he seems to be refusing to do it anyway.

Given the cost of the microscope, he is not being very fair or honest.

 

I think you have lost your money. You can't do much legally as any Australian laws don't apply overseas anyway. You say your appeals have been rejected by ebay 3 times, so they have dug in their heels.

For your information, you're not the first person this sort of thing has happened to and just about every time it happens, it is an expensive item to someone overseas and the seller loses the item, the money plus is hit with fees. Yes, it is pretty poor ebay awards the buyer both money and free item but the thing is, they expect the seller to sort it out before a case closes. As you have discovered, it is much harder to do this for someone overseas. In Australia, you could just issue a return postage label.

 

For the future, limit sales to Australia only. 

Maybe sell smaller items till you get a higher feedback score and don't appear such a target for scammers.

I am sorry you have learned this very expensive lesson. The steps eBay explained would have been followed IF you had been able to send a return postage label. But you couldn’t – not because the item was in the USA or because it was a “medical item” or because of a problem with US customs – but because it is not possible for someone in Australia to send a return postage label to someone in another country. So the next steps in the eBay INAD process were carried out.

 

As has been said it is possible to negotiate with someone in good faith by paying them in advance for the cost of returning the parcel; I have done this once in my years on eBay. The negative Feedback I have now came from someone in USA who I assume confused inches with cms; I refunded them instantly as I knew there was no other reasonable path to follow.

 

So really the uptake is that eBay’s Seller Protection does not work for overseas sales from Australia. And as others have said, your zero Feedback could have marked you out to anyone wanting to obtain an expensive item for free. You can’t absolutely be sure of the circumstances here but I am sure you will (rightly) be very wary of listing expensive items for International sale again. I do not list anything over about $500 for International sale for this reason, and when an International bid comes about, I am very quick to check the buyer’s Feedback (as a Buyer/Seller, Left for Others) for anything that looks troublesome; bids can be cancelled and bidders blocked. Not the case for an outright sale of course, but I do not sell the type of item (expensive designer watches, handbags, phones, electronic goods etc) that are likely to catch the eye of a would be scammer and I would hope that my Feedback would deter them anyway.

 

Again I sympathise with your loss and understand why you feel let down by eBay. If you decide to remain on the platform as a seller, do follow the advice already given; start slowly with lowish value items in Australia only, until you build up more Feedback and experience.

All I risk on any of these sites is up to $20 to purchase the stock and the postage charges. If I cant get something for less than $20 then it never gets listed for sale. That way you might get scammed out of the $1800 but it only cost you $20 and postage at worst. These sites couldn't care less about sellers and the postage "service" isn't much better.

The only scam I encounter for low price items on a regular basis is the standard "single mother expects everything for free" line. If ebay wants to cover that racket then so be it.  I block the "buyer" whenever they open a claim regardless of the result, other than the time that ebay put in incorrect measurements instead of  importing the actual details of the listing. That was a fair "not as described" even if the buyer showed a lack of any communication skills whatsoever.

The fact that seller is not protected for selling expensive item to USA is not mentioned in eBay when you start selling.

 

I have received the message “ rest assured you’re protected by eBay agents all the way until they closed the case and refunded buyer.

I was told that eBay will step in and help.

“shm30”declined the offer to be prepaid to send the item as per a quote he obtained. He was only accepting a label and no other solution and even eBay admitted that I cannot send him a label.

so why knowing all this eBay closed the case in his favour, and ridiculously charged me for sale commission and extras.

The only response they provide now is that get in contact with shm30 and ask buyer to send you the microscope but of course I have done it and they can see that in the eBay messages.

ebay should have clicked this sale to US from beginning or warned me and I wouldn’t have send it overseas. 
After this happened, and admitting their shortcomings, they refuse to help me.

A big company like eBay should be able to protect seller if his policies are not clear or adequate to protect their customers.

This financial loss is forced upon me by eBay due to lack of support for seller and I should have been warned.

Is eBay so desperate that knowing that I am completely right, refuses to refund me and even charges me sale tax and service when I have had a complete loss of property and funds??????

I want everyone to be aware of this. It’s a scam.

eBay still got his money out of this and shm30 is very happy that eBay helped him get an expensive item from overseas for free with pushing a few buttons only.

This is ridiculous. I wish people like me do not get into this mess (buyer scam supported by eBay).

If it's any consolation. 99% of buyers here and on ETSY are honest folk. You just lucked out with a big-ticket item rookie mistake. Sell junk and you will have fewer problems.
