Hi All,

I need some help. I sold a dress that came BNWT but the weight of the tags had dislodged the label so instead of hanging by one thread in each corner, the label now just hung by one thread at one corner. It was still completely attached but I made sure to include a photo of the condition in the original listing just in case.

The buyer first wanted a return because the dress was 'too long for them' and the tag was hanging by a thread. When I refused, they raised a case against me for the tag saying that the condition wasn't clearly shown in the photos or the description. I did very clearly include it in the photos - it couldn't be more obvious.

In the photos that the buyer sent through on their case, they are clearly pulling hard on the label to make it look much worse than it is. I get the feeling that they've just had a change in mind. The designer label is on the inside of the dress, it's not something you can see when worn. They took a good week and a half to pay originally.

The dress is $400 and postage cost me $13.50. I would rather not return the item because it simply didn't suit someone. Especially as I believe that I was completely transparent. Do I have a good case or should I just refund them?

There is also a good chance the buyer has now worn it to the one function it was intended for.

Unfortunately that is a common scam.

To be fair, the buyer did message me a few hours after the tracking showed the item as delivered. I definitely got the feeling that they'd just changed their mind or that the dress didn't suit them. Personally, if I bought a dress and the label wasn't fully attached but at least still there - I wouldn't have an issue as long as the dress was in good condition. Although, I understand not everyone is like that which was why I originally included the photo.

You need to call ebay for this one. They will look through the messages sent by the buyer and check the listing, and will hopefully agree that it is buyer's remorse. Did you have returns accepted in the listing? That may affect what advice or options eBay will provide. (You can also request a call back, I usually prefer that option).

Was it the Zimmermann dress? I know buyers can and will use any excuse to return something if they decide it doesn't suit, but to be fair it's not super obvious in the photo you provided that the label is detached and you didn't mention it in the description just that the dress is BNWT which would suggest it's off the rack perfect.

If I was the buyer I would MAYBE be concerned about something like that just because Zimmermann is a counterfeited brand, particularly the dresses and dodgy labels can be a sign of this (same with Self Portrait branded stuff).

Probably not, as the OP said the dress was $400, and the Zimmermann one was only 81.

There was still nothing in the description about the tag on the $400 dress. (Zimmerman)

 

No returns.

 

To me the close up looks like the tag ripped a hole in the dress.  Might be wrong, but....

There was a Zimmerman dress sold on the 4th March for $400.....that is probably to one.  It has very little written description.

Hi All - thanks the replies. I'm on my phone so I can't double check but the 4th of March sounds reasonable. That's correct, I didn't include it in the description. This wasn't on purpose but just an oversight. I thought the photo would be enough. To me it was pretty clear. The description was minimal as the dress is literally BNWT, I usually only do measurements when buyers ask.

There was no damage done to the dress! There's no holes or anything. It's in perfect brand new condition. Apart from the label hanging by one thread instead of 4.

Anyway, after quite a few angry messages from the buyer, I've just decided to refund the money. I'll just re-sell it again and this time ensure I include the condition of tag in the picture.

I'm still quite sure that the buyer has had buyers remorse as originally they just mentioned that the dress was too long for them.

Accept the return and don't refund until you have it back. If you refund first, you'll never get it back.

 

Edit: looking at the tag, it looks like you have just photographed the tag to show what it said. It should have been mentioned in the description. You have to mention absolutely everything, even a loose thread in a seam. If you miss one little thing, the vultures will have you.
