Yes, they can.
The difference is that now, if the case is closed without payment, the neg should automatically be removed, and if it's not, contacting eBay should see it removed fairly quickly.

Yep, I got neg'd after making contact and eventually opening an UPI, I got it removed by eBay.:)

Thanks!! I would have thought it would be impossible for them to neg us if a case was open.... but at least the neg can be removed, that's good to know.
I've recently had two winning bidders not pay for the SAME ITEM, twice in a row!

It's really a stupid way of doing things.
The minute a dispute is opened by either party, the ability to leave feedback should cease until the matter is sorted.
ebay may very well remove neg FB for a seller after a dispute closes, but that can take 8 days. That's up to 8 days of a bright red dot sitting there for potential buyers to see.

That's one area where being a Power Seller can be beneficial - negs and neuts can't be left for a PS until 7 days after the transaction.
It actually says on the help pages that "You can't leave negative or neutral Feedback for a seller if an unpaid item case is open on your account" (I went to check the time frame for negs/neuts for PS's), but I was sure there's been recent cases where a seller has received a neg after the dispute has been opened and before it's closed. ?:|

I read about that only recently DG. There's a thread somewhere on the first page I think. Apparently after the dispute it closed, then it's removed.
In regards to PS's. I'm not far off believe it or not. But if I am reading it correctly, it will restart (the required sold amount) at the end of the month?

Only one month's worth of sales from last year should drop off the count at the next evaluation (and soon, the threshold will be reduced to US$1000).

I have had a couple of rogue items like that, I was determined they would be paid for by somebody eventually so relisted them every time there was a free listing promotion. One was paid for after being 'sold' about 10 times and the other 6.
The funniest thing was the second one was returned to me weeks later as undeliverable. After waiting a few weeks for them to get in touch I donated it :^O
