TRACKING CLEARLY SHOWS ATTEMPTED DELIVERY. SO NOW I AM RESPONSIBLE FOR BUYERS THAT DO NOT WISH TO COLLECT THEIR ITEMS AND HAVE THEM RETURN ON PURPOSE OR BUYERS WHO PROVIDE WRONG ADDRESSES!!!!! I HOME ONE DAY SOON CONSUMER GROUPS SUCH AS ACCC FINE YOU MILLIONS FOR HAVING WORST PRACTICES IN THE MARKET!!

What is the package status as of now?

 

In some cases, this part of the MBG will (or should) apply, which means you may have success appealing the decsion and defect - I know it relates more specifically to refused delivery, but when an item is sent via Click & Collect (Woolies etc), the buyer isn't eligible for the MBG if they don't collect, so logic would generally dictate that if a package spent any time 'awaiting collection', similar policies should apply.

 

Generally, the buyer is responsible for accepting the item when it arrives. If the buyer refuses delivery, their claim is not eligible for eBay Money Back Guarantee.

 

Exceptions:

 

  • The buyer can provide, via written proof from the carrier, that they refused the package because it arrived empty or was damaged in transit
  • The item arrived COD because it didn't have enough postage on it

I just realised that's almost a direct contradiction of one of the other policies in the MBG.... (I shouldn't be surprised, but Smiley Surprised anyway).

 

Further up the policy page, under 'not covered', it states - "Items damaged during pick-up or postage"

 

So, if items damaged during transit aren't covered, what difference does it make if the buyer refuses delivery and then provides written proof that the package was damaged in transit? 

 

Maybe it's like some kind of Schrรถdinger clause - if the package is damaged in transit, the item exists in a state of being both damaged and not damaged and therefore the previous clause does not apply? Smiley LOL

There's another contradiction in their MBG policy where it states returned items must be sent back "in the same condition it was received".

 

That is one of the biggest contradictions.

 

I've stated in other posts where a buyer claimed SNAD, said I listed the size wrong. I accept the return, despite my photo showing the correct size, he sends a photo of "an inner tag" which had a different size. I paid for the return post, he sends back a totally different item, gets his money back and my item.

 

When I brought this to eBays attention they simply said"well the buyer returned an item so we must refund them". I said but he didn't return the same item, he returned a badly worn and faded item" eBays response " well we don't physically see the item so we have to go with what the buyer said"  PFFFT!!!!
