Ebay gives refund because item was late

I'm at a loss here.

 

Ebay has just refunded in full (without asking for the item to be returned) because the item was "LATE" acording to ebay's schedule "Get it Free & Fast by ???"

 

Despite the attached note saying delivery might take longer in peak periods, a buyer complained that it was "late" according to ebay's schedule and demanded a full refund.

 

Ebay obliged without asking for the buyer to send it back. I appealed but ebay dismissed my appeal.

 

What gives? So I can order an item on ebay, say it's late, get a full refund and get away with fraud?

 

I can't afford to give away my products.

 

What can I do?

Maybe you could fight paypal because ebay has no right to take the money from your paypal account for such a thing. Can someone point me to where in ebays policy it states that a buyer will be refunded if an order doesn't arrive by the estimated delivery date, or they will be refunded if something is posted late.

 

If they are taking money because something is posted late the transaction should be cancelled prior to posting (and never posted).

eBay post handling days are business days.

When a seller has specified a handling time and a certain postage services with transit times, eBay will provide buyers with an estimated delivery time. By knowing the estimated delivery time, you can determine how long it will take to receive the item. “Business days” are normal weekdays. Saturdays, Sundays, and major holidays do not count as business days, , so you’ll want to keep them in mind as you determine the earliest delivery date for you.

Just to clarify a couple of things - you do not need to have a 0-1 day handling time for Fast n Free. You do for eBay premium service, but FnF is just a logo that says the item is likely to arrive quickly. I've had it on my own listings with a 2 day handling time because eBay estimate that I'd receive it within 4 days if I bought it from myself. 😄

 

The other thing... this line "successful on-time delivery" is actually starting to convince me eBay does consider delivered as handed over to the carrier. 

 

Could you imagine the fall-out if eBay truly thought it was ok to promise an ETA on behalf of the seller, not based on AP's (or most other carrier's) actual delivery time frames, and refunded buyer's because those carriers took longer than eBay and/or the buyer thought they should? 😮

 

No, I suspect "on time delivery" is "on time postage", particularly given that's basically what it means in the US - they can pensalise the seller / refund the buyer if the seller doesn't post according to their handling time, but they can't / don't if the item was posted within the handling time (and they can prove it).

I know that in the US they can, but the MBG is more explicit in that regard - but, as I said, over there it comes under 'item not as described' so the item is supposed to be returned to the seller (it used to be INR, but it looks like they changed it).

I have not seen the equivalent of that in Australia's MBG, unless "on time delivery" means the same thing, but it may be worth pointing out there isn't an explicit provision for this circumstance in Australia's MBG (which would mean it doesn't matter whether the seller can prove they shipped the item within their stated handling time, only that eBay incorrectly applied a differen't country's policy).

Actually, it does.

 

The most pertinent line is this one.

 

"You can increase your chance of having the Fast 'N Free logo appear on your listings by following all the usual best practices".

 

It doesn't say your listings have to meet that criteria, only that doing so gives your items a better chance of getting the FnF logo.
