We recently sold a pair of boots with very descriptive pics, a month later the buyers says she wore them a few times and wasnt happy with the size and that they had marks on them that she couldnt see in the pics. She puts in a refund request and no matter what we have to issue a refund even if she doesnt send them back.

What reason did the buyer give for returning them as if it comes up as a change of mind purchase you don't have to accept them back.
If the buyer has chosen the reason - does not match description if it is after 30 days since they received them then you also don't have to accept the return.

If you have it in writing that her main gripe was that the fit wasn't ideal for her, then I would be ringing ebay to fight it.
If she has worn them a few times, she may have put the marks on them.

You sold them on the 21/7 so the 30 days for her to complain is past due so ebay won't do a thing.
But if she paid with PayPal then she has 180 days to open a case.

Indeed, the reason the buyer was able to open a return request is because eBay are keen to give you the opportunity to offer exceptional customer service and offer a refund etc etc outside of the 30 days, but you are not obligated to (and I sure wouldn't).
What I would do though is take screenshots of the original listing and the tracking showing delivered and the View Order details page which links the item to the tracking number before it all disappears from the ebay site. That way if (when) she opens a case it paypal you have all the information and proof of delivery possible.

i accepted a return from a buyer, as I only saw the email the day before I had to respond or would've been closed against me. Buyer claims item didn't match description, uploaded a photo of the size tag, which I did not include in the listing, but did include a pic of the inner waist which had the size printed on it. Though it must have been a misprint. He claimed the jeans were too short, despite me including measurements, so accepted the return.mthis was a $100 item. After a week and he hadn't returned them I contacted eBay who told me I should've rung them first, as this was clearly change of mind, buyers remorse. Had I known and done that before accepting the return eBay could have closed the dispute, but now had to let it run its course.
Got a parcel with jeans in it back, Mine were Hugo Boss Orange, and buyer sent back a completely different pair Boss Red, when I pointed this out he became extremely abusive. Rang eBay, told them I got back a different pair of jeans, badly faded and well worn, compared to my as new jeans, and then eBay said because he sent back an item with tracking the dispute would close in buyers favour! Total BS. eBay said they can't verify that I didn't send him the jeans I advertised nor could they verify what I received back. In other words, no matter that I sent the buyer what he purchased, I am basically a liar in eBays eyes.
i then sent numerous emails containing the photos of my item to the buyer with photos of what I got back, and low and behold he responds with "ahhh I see what has happened. Yes I sent the wrong jeans back, apologies" reckons he will send them back but not holding my breath. I contacted ACORN and lodged a complaint, it's now been forwarded to Police Fraud Squad so will see what happens from.
The whole returns system is completely fraud and there is NO protection for sellers when buyers send back wrong items, or use Not as Described, instead of Change of Mind.

The buyer has stated that she has worn them a few times - therefore they can't be in the same condition as sold, surely this invalidates any legitimate return?

If you're returning an item for a refund, send the item back to the seller within five business days of requesting the return (with tracking).
Return the item in the same condition as you received it.

Knowing eBay they will say "we can't verify blah blah blah"
the dispute process is terrible for sellers.
the 2 things that really gripe me are
a) "we can't verify the returned item or what you sent carp
but even worse
b) when eBay issue a refund WITHOUT the need to return the item! That is total BS!
