General opinion on refunding for plants

Ebay originally was set up to sell 2nd hand goods online. A live trading post if you will.-the selling of "surplus to requirements". How it is has changed!!!!
So in the light of this how do live plants fall in the refund catergory?
Particularly under paypal policy a buyer can, tecnically, make a claim, return the dead plant via registered post within 45 days and paypal will pay.
If I went to a nursery, bought a plant, planted it and 30 days later it died I would have no recourse.
Why?
Because growing conditions are out of the nurserymans control. Once it leaves the nursery in healthy condition nobody can guarantee it will grow for me, at my place, in my dirt under my care.
So why should plants sold on ebay be any different?

Sweetpea hasn't visited the boards in FIVE years; and asked the question EIGHT years ago.
I know for a fact that at least one of the other responders is deceased.
I would suggest you research what you particular state's regulations are. And if you are concerned about your legal rights to complain, I further suggest you don't buy online.
Edit: Snap, padi. Another bottle of proper whisky...
