How do I claim compensation from paypal?

I sold an item and sent it to the address supplied by ebay. (I have a copy of the email) the buyer contacted me to say his item had not arrived and I told him it was posted 10 days prior. He emailed to make sure it was posted to the correct address and when I gave him the address the item was posted to, he said he had not been there for two years. He had feedback for only two items, so my guess is that he had not changed his mailing address. However, paypal have found in the buyers favour and I want to claim for reimbursement of the funds lost. This is either the buyers fault or eBays fault. Does anyone know how I go about claiming?

Yes that is correct.  The address selected at checkout may not even be the buyers eBay or paypal registered address ie such as when sending a gift..

 

Changing eBay or Paypal addresses after sale does not change the address on existing eBay purchase order forms.

 

If a buyer has NOT gone through checkout, the ONLY address is should be sent to is the address on the PAYPAL payment advice (as the eBay address on the order form has not been verified, and may not match the paypal advice)..

 

The only other way is to change the ship to address is to go through the eBay checkout prior to payment and nominate the address you wish to post to.

I recently had a claim against me where the buyer claimed not to have recieved the item.  I tracked the item and worked out Australia Posts label sytem stuffed up and didnt print the full address consequently it was returned to sender.  Once I recievd it back I offered to send to the buyer  (by express post) the item. He agreed and I sent it back.  In the interim he filed a claim to Paypal and they gave him the full cost of item and his postage costs back.  He then recieved item and kept it without paying.

 

Patpal said because the case closed in his favour they cant do anything (other than send a polite email to the buyer which they did) even though they can see through tracking that he now has the item.  I have lodged a complaint about this buyer to paypal and ebay but all they have done is said I have to resolve it myself with the buyer.  This is not possible when the buyer doesnt respond to my requests for payment.

 

Can I report Paypal or the buyer to some kind of Ombudsman?

Absolutely. The Financial Ombudsmans Service at https://fos.org.au/ will see to it that Paypal reimburse you for their unconscionable actions by not repaying you for the loss you suffered as a result of their abject stupidity and incompetence. You may even want to ring Paypal first and let them know your intentions, as I suspect they will immediately reimburse you for your loss pretty much while you're on the phone with them, as the FOS is the one organisation that actually has the power to revoke Paypal's licence to operate in Australia.

? Paypal claims don't open and close in a couple of days ? If the documentation you provided for post was not enough you usually are given additional time to provide.

 

What was the timeframe involved ?    Did you provide all the necessary evidence for paypal to consider ?  A random tracking number is not going to prove much ?  Did you provide addressee proof or lodgement proof to Paypal ?

cq_tech - from my understanding of what the seller has written Paypal have followed procedure so I can't see any reason why the ombudsman should be involved.

 

The way I read the situation is that the buyer didn't receive their item so they opened an INR case in Paypal which was awarded in their favour as they didn't have their item.

 

After the case was closed the seller received the parcel back as it was incorrectly addresssed which shows the buyer didn't receive it. The seller then offered to resend the parcel which they did and the buyer received it after the case was closed by Paypal. The seller is now dealing with a buyer who hasn't paid but that is not Paypal's problem. The seller should have asked for repayment prior to resending the parcel.

 

It is not Paypal's fault the address was incorrect in the first place.

Jens, I interpreted it differently in that the buyer lodged (and won) a claim after agreeing to wait for the returned item to be resent, so at best he has defrauded Paypal, but if Paypal knew that the item was being resent they shouldn't have approved the claim, in which case, they are in the wrong. Perhaps more information and a more accurate timeline are required here before blame can be apportioned.

I also read it as the parcel was resent then the claim made.

I agree, more information is needed prior to anyone is advised that they should complain to the PIO.
