i recently discovered legitimate german OEM windows 10 keys cheap on german ebay, i did my research
https://www3.wcl.american.edu/cni/0007/26339.html
http://www.theregister.co.uk/2002/05/08/selling_oem_windows_copies_you/
and many other sources
i purchased sample keys from many german power sellers etc who sell 2500 keys a month all with good feedback, an example is

purchased some test samples and activated them with MS on the phone, voila legitimate OEM DM channel keys
MS promised i would never have a problem with
so i setup another EBAY account after i promised never to to so again [another story] i placed 10 adverts the maximum and all keys sold in a few days, i sent the codes out good feedback being left from people buying them, then i received this from ebay

Even if MS lost the right to how their keys are used in Europe does not mean the same applies in Australia. As you know these are two different markets and this jurisdictions. As to the reasons why the sales were cancelled, Ebay won't try very hard in providing you the precise reasons which makes it difficult for you to dispute.
Your issue is quite interesting however and depending on how it is approached you may or may not have the right to sell those keys. Australia's anti-competitive behaviour laws are very behind and limited compared to Europe. (My European cousin - a lawyer who specialises in anti-competitive behaviour - came to work in Australia and gave some interesting insights).
The seller that sold you the original keys may be allowed to sell those keys in Europe but is he permitted to sell those keys in Australia? You tried to but Ebay stopped you. However what if your account is registered in Europe? Could Microsoft complain then? Or what if both the seller's and buyer's account is registered in Europe but the key is either delivered or used in Australia?
In some industries companies that have never set foot in Australia are required to have a permit to provide their services to people based in Australia even if those services are only provided throught the internet. However this is only required if those companies actively seek customers in Australia and not if those same customers contact the company to use the service (to a certain limit).
All up it's pretty messy and will keep plenty expensive lawyers happily employed for years to come.

@davo11111 wrote:microsoft would never give me permission to sell its products, that sounds too much like a free marketplace, however if i buy a microsoft product in a country that has ruled microsofts ownership of the license ends when it sells the product, then i can resell that product in australia providing it doesnt break any consumer or import law, which it doesnt
obviously i dont have the resources to take microsoft to court but im angry ebay refunded all the money from my sales and restricted my account i have no chance of getting codes from my happy customers who have already activated them and have now been refunded, at my expense
eBays VeRO program is vexed IMO as there is no due process in place, and the policy oversimplifies a complex area of law, JMO JMO JMO .
If paypal facilitated the refunds you have clear recourse through them - perhaps consider tackling this situation from that angle. Paypal are held to higher account by Australian authorities due to the more stingent requirements of Oz financial institutions. Just my advice, no expert, there are others who seem to know it all in this discussion.

The only way I can see thru this is to get Microsoft to back you and get in touch with ebay on your behalf to have these restrictions removed and confirm for them that they are valid licence keys. This is also the advice from ebay in the message you have provided.
Since it seems the complaint has come from MS themselves then the only source ebay will take notice of at this point is MS.

What is legal in Europe is not neccessarily legal in Australia.
Here you have to be an authorised reseller of the goods, not just have legal goods.

they took me down for copyright infringement, besides, the court cases in europe say microsoft has lost the right to say how the keys are used or resold once they have sold them

im sure if i was selling australian licenses, microsofts so called authorised reseller law would apply to me, but i am selling products from germany, as if i had flown there, purchased them and flown back, i am not under any licensing obligation and fail to see how microsoft have the power to freeze my account, i further fail to see how ebay can allow me to purchase from a powerseller who has the rights to resell to anyone anywhere but forbid me to sell the same thing or forfeit the account

It makes no difference where you source you products. If you are selling genuine Microsoft items then you have to be an authorised reseller of the product in Australia.

I think that's pretty much the same rules for any brand name products. eg Disney.
You have to be a licensed and authorised reseller by the brand owner.
If you are not and the rights owner complains to ebay under the VERO program ebay will end your listings until you can prove otherwise to them. If you are a licence reseller then you had better display that licence in your listings.

like i said in the headline.... poppycock, its not even a law, its a rule, its a company policy from another country thats being played out as a law here in australia with sufficient force to freeze my account and make me lose money on transactions already paid for,
the weakest anti consumer laws ive ever seen if true, and a testamant to aussie politicians complete sellout to big business
and us, the so called voter, enabling it

Well if that's the way you see it then I think you have no further recourse other than to take legal action of your own.
Would be interested to see the outcome. But I think I know what it would be.
