That's why streaming companies like Netflix have different shows in different countries, because they are restricted by licensing agreements.
What is or isn't applicable (in terms of licensing and copyright ) in this particular case, I couldn't say for sure... but I suspect very few people who weren't highly informed of both copyright laws and Microsoft's rights in Australia would be able to.
Very much agree.
Though isn't it amazing that we have had such definitive advice on this thread ... wow.... wonders never cease.
OP I doubt, in its own best interests, that Microsoft would ever give you the tick to resell - whether it is legal or not. Why would they ?

People have read the links. You've got the answers. You can't see it on eBay Australia without permission from Micro$oft. It doesn't matter what laws are in other countries, you can sell them here, period.

microsoft would never give me permission to sell its products, that sounds too much like a free marketplace, however if i buy a microsoft product in a country that has ruled microsofts ownership of the license ends when it sells the product, then i can resell that product in australia providing it doesnt break any consumer or import law, which it doesnt
obviously i dont have the resources to take microsoft to court but im angry ebay refunded all the money from my sales and restricted my account i have no chance of getting codes from my happy customers who have already activated them and have now been refunded, at my expense

Just because you don't agree with the answers to your question doesn't make them wrong or negative.
As you say, you can't afford to take on MS and eBay are not going to take them on by leaving your listings extant once MS has invoked the Vero programme.

interesting link, it looks like it covers australian licensed keys, i have no issue with that, the problem microsoft has, is that the law in europe overuled the need to bundle the keys with a computer, and that these keys were able to be resold without a computer, and that once microsoft had sold the keys once, they couldnt sell them again nor could they control who purchased them, this law didnt just apply to microsoft, it applies to all software, games included, these keys fall under that ruling, microsoft is flouting european law but theres not much i can do about it

And what would that be?
If eBay has restricted your account (with a whopping 3 feedback - must be some kind of record), you won't be able to sell anything else ever again anyway, so this is really all a non issue. Once they can your selling ability, that's it. Never to be reinstated. As soon as you create a new account to bypass the restriction, it will get knocked on the head too.
As I said earlier, if you think you are right, stick it to them and relist. Oh that's right.........you can't.
