Money Back Guarantee Policy

I am a casual eBay seller basically just selling my unwanted items (mainly collectables).  I have ended all my items so that I can assess the impact of the new money back guarantee policy. If I only sell items for 'Pickup Only' (either by cash or paypal), does the new policy still apply even though I make sure the buyer is fully satisfied with the item on pickup?

Sorry I am just really confused with this policy? Ebay is not a financial institution then how can it then act as an escrow service as it doesn't have the license to do so.  PayPal has the funds on hold in your paypal account so therefore aren't they then responsible for releasing those funds?

I'm more confused by the back and forward of posters who have been here for so long, maybe it is the heat ?

 

TB's advice, while sometimes hard to understand on a legal level, is usually golden, and the other members usually give pretty good advice as well, so this bickering is beyond me.

 

People, we can't all be experts on all things, some of us will know more about one thing than another, and together, hopefully a members questions can be answered.

 

With this thread, I think the OP (who hasn't been back since the OP BTW)  is more confused than they would have been in the beginning.  I know I am Smiley Tongue

Debating a subject IMO is not bickering.

 

As long as TB advises newbies to revoke permission for eBay to access Paypal funds by sending to Paypal his "I think I am a lawyer and will act like one bugger the consequences" script, I will raise the pontential implications for others considering taking this action.

Im confused,  on a legal level my daughter is a lawyer so I can ask her sorry tb, I just want to know how can ebay be responsible for funds held if paypal are holding the funds? Ebay couldn't hold funds because they are not a financial institution and if paypal is no longer part of ebay then they have no right to hold funds on the advice of a third party being ebay unless the claim is put through paypal directly by the purchaser,  this is where the money back guarantee is very grey.

Our user agreements were rewritten by eBay to allow eBay to direct or recover Money Back Guarantee funds from Paypal accounts or to invoice the same to us. 

 

"Sellers must have a payment method on file with eBay. Sellers may change this payment method at any time. If we resolve a case in the buyer's favour, eBay may notify PayPal of the relevant case and seek to remove funds from the seller's PayPal account to reimburse the buyer for the full cost of the item, and postage. Where there are insufficient funds in the seller's PayPal account, we will directly refund the buyer and charge the seller's designated payment method or put the amount on the seller's invoice ("Reimbursement").

For this purpose, you, in the capacity of a seller:

  • authorise and instruct us and PayPal to collect or reverse variable amounts (representing payments related to covered claims) from your PayPal account to carry out a buyer reimbursement;

  • authorise and instruct us to request PayPal to collect or reverse variable amounts in other currency holdings (representing payments related to eligible claims) from your PayPal account to carry out a buyer reimbursement where you do not have sufficient funds available in the transaction currency;

  • authorise and instruct us to request PayPal to restrict your access to funds (the restriction will apply up to a sum equivalent to the cost of the item and original postage costs paid by the buyer) in your PayPal account at any point during the resolution process (which may result in PayPal determining to restrict funds in your PayPal account in order to manage PayPal's risk exposure pursuant to PayPal policies – see clause 11: Restricting funds);

  • authorise and instruct us to charge the payment method you select to recover the amount we pay to the buyer (in cases where we refund the buyer directly); and

  • authorise and instruct us to place the reimbursement amount on the seller invoice.

You acknowledge and agree that your authorisations above will be made on a recurring basis and on various dates as required by us to implement the terms of the eBay Money Back Guarantee policy. If sellers do not provide eBay with a valid reimbursement method, we may collect the outstanding sums using other collection mechanisms, including retaining collection agencies. We may suspend the eBay Money Back Guarantee policy without notice if we suspect abuse or interference with the proper working of the policy.

We reserve the right to fix any processing errors we discover. We will correct any processing errors by debiting or crediting the payment method used for the eBay Money Back Guarantee refund or reimbursement."
