Due to a malicious and wrongful withdrawal of one of our listings by eBay just a few days ago, I am now looking at withdrawing all our listings and giving eBay a miss altogether on two sites. This has come as the last straw. Ebay has offered no explanation or apology. A message stated we were trying to evade ebay fees on this particular listing which was utter rubbish. I also got a 3 days suspension from listing! The listing in questrion was for a TAMS WARE part dinner service in which 6 pieces had damage so I excluded these pieces from number of items offered but added if anyone wanted the damaged pieces, they could have them. Somehow eBay wrongly construed this as we were offering the pieces for an extra payment (outside of Ebay) which certainly wasn't the case and I can't even see how they reasoned this. They were free if wanted and if not they would have gone in the bin. It has become a nightmare and I can't reason with eBay. Ironically, I immediately relisted this dinner set on another site and it sold within hours of putting it up and even though it was listed a few dollars cheaper than here, I have came out better off (items were paid for and collected the next day) so I don't know why I'm here any longer. As far as I'm concerned eBay has shot themselves in the foot regarding this. They are going to lose so much more now than their pathetic claim of losing fees which was never the case anyway. I'm still reeling how they could be so bloody minded!
Had to vent, I'm so disgusted with them.

Fair enough all that matters is where you can sell your items better.

I can understand your frustrations. I have also had account restrictions by ebay for similar non - sensical reasons. No amount of reasonable discussion with customer service changed thier minds. I try to take the attitude that if you are going to sell on this site, you need to be able to roll with the punches a bit. Not only from ebay itself but also with the occasional customer. If you take it all too seriously, it can be very stressfull. Sometimes this is easier said than done.

It seems eBay has embarked on a process of punishing their sellers for the slightest perceived infringement of their rules. I heard of another similar violation recently and have now experienced it myself in relation to direct selling (it was also the way I expressed something - and was found guilty, never to be proven innocent). It seems they are worried about eBayers selling outside of eBay, and this has led to an indiscriminate crackdown. But this is Australia, and under Australian law, we are innocent til proven guilty!. Actually your free dinnerware may have clinched the sale that may have been lower value or not at all, and if the buyer did not want it, so what. eBay gains every which way out of your ad which to me is a legitimate way of selling something that is in the buyer's best interest, and hence eBay's. So don't ever think about offering a free set of steak knives. I am also considering getting out of eBay and using Gumtree because of this fictitious violation and their subsequent threatening remarks.

Gumtree is owned by eBay. And is designed for pickup items. If you have those, go for it.
But if you wish to avail yourself of the wider potential buyer catchment of eBay it is generally better to abide by their rules. Regardless of your misinterpration of the law.

maybe - should have sold the dinner set - all the good bits then once buyer has contacted you / paid etc, offer the damaged bits for free if they wanted them.

Totally LOVE that link !! It really helps when you feel yourself experiencing the ' fallout ' of ebay at its worst.
People say customer service at Microsoft is bad.
I've had no experience of it.
How does it compare with ebay ?

I guess to some it might look like a compromise or even a sell out, but the fact is, after the sting goes away, what it really boils down to is a simple matter of rewording - eBay are a bit like a tantrum-throwing kid, they kick and scream and sometimes get someone in the shins (and never say sorry...), but I can get angry too, or I can continue offering the same thing I always had been, and just look to children's literature for inspiration so it's all spelled out in a way eBay will "get" .
This is my item. My item is for sale. This item is blue.
I can make pink ones, too. If you would like a pink one, I will list it on eBay...
If / when eBay ever did something that caused me to compromise my business ethic or integrity, that's when I'd be walking.
