Strange goings on with shipping address changes

Have had a buyer who won an item then 4 days later sent a long message about being unable to afford item and people using her phone and bidding without her permission  Etc Etc --my unpaid item assist kicked in after 5 days and opened UIC ---She then changes shipping address and pays --Ive shipped to previous address --Im preparing for item not recieved--As its a completly different address & postcode --Contacted Ebay & they made a note of what had happened & couldnt understand why she had done that in the middle of an UICase and advised me to contact Aus post to stop the shipment ??????What The??????

You really need to read thru the Sale Of Goods Act (SOGA) as applicable in your state.

In the QLD one the relevant section is:

Part 4--Performance of the contract

This might be different in other states as this is a state-based act.

This section talks about rights and responsibilities of the buyer and seller regarding sales and delivery.

But as pointed out by Lyndal why would you go to the expense of going to court when the rules for both ebay and PayPal are very clear.

Use the address given by PayPal or forfeit your rights as a seller.

And I think you will find this is pretty much backed up by the SOGA rules anyway.

When you use the ebay selling platform and accept PayPal as payment then you are deemed to accept their rules of the game.

And unless ebay/paypal are blatantly breaking the laws of the land a court will probably uphold their position.

i was on the phone to ebay on another matter then i asked them about the policy , and she said  as long as you send it to the buyers ebay address  or paypals address you will be covered. 100%

and she did verify about messages dont count.

Where you will have trouble with this CSR's interpretation is when a buyer forgets to update their addresses in both places.

Perhaps they moved house and logged into their paypal account and changed thier mailing address thinking that this is all they need to do. Or just changed the address to the correct one at the time of checkout. They have forgotten to change their registered ebay address so it still reflects their old address.

Then they buy something (a tin of paint from you say) and pay with paypal which is now their correct new address.

If you mail to the ebay address they are not going to get their item as it will go to their old address in timbuktu somewhere.

Once again when they raise an INR you will lose the case becasue you have not used the paypal address but instead the address given by ebay which is not correct. Ebay will not support you even tho you used the address given by ebay.

So the rule is always mail to the paypal address then you are covered 100%. No matter what the buyer tells you otherwise.

If they pay by some other means (not paypal) then you have no choice but to use the ebay address as this will be all you have.

In this case I believe the buyer has no rights anyway as they chose not to use paypal to pay for it. So they cannnot even open an INR case against you.

confirmed a few times as long as its to an ebay  or paypal address you are fine,  anyway i will see if this happends again

under ebays policy you are now covered and paypal policy the same.

No Joe, that is not right.

Despite what you were told, you are not covered for seller protection if you send to the ebay address if the buyer has paid with paypal and that address is different.

You MUST send to the paypal address if that is how the buyer paid.

i dont know if the policy has changed or what ,i can only go by what ebay have stated ,and she repeated these words to me , as long as you use an ebay address  you are covered under ebay, then she said as long as you use a paypal address you are also covered by paypal .. i asked 3 questions  the other was if i get a message from a buyer of a new address ,i was told as you all said i am not covered under ebay or paypal under there system. maybe if you give them on a call back system which was about 10 seconds today ,must of been a quiet time, also an english speaking person on the phone ,which was great.

Joe, I don't really care enough to be bothered ringing ebay or paypal. 

I am not a seller so it really does not affect me at all.  

As a buyer there are never any address issues as my ebay and paypal registered address is the same as my delivery address....the one and only address I have had for 45 years.

If you re-read all the posts on this thread by sellers who also know the rules you will see that they all say the same thing....for paypal seller protection you need to send to the address on the paypal notification, not the registered address on ebay.

I am not going to argue with you any more.....if you want to buck the system go right ahead but don't come here complaining when you get scammed by a buyer who also knows the rules and follows them.

Did she tell you that there are technically two eBay addresses, which can be the same, or can be completely different?

The first is the one on the sold notification, which will be the buyer's default (or primary) postage address that they registered on eBay. The second is the one that they use during checkout - that one, the checkout one - will update to eBay and be visible on the order details, so becomes (for all intents and purposes) the "eBay" address, and if the buyer used PayPal to pay, it will also be the PayPal address.

The sold notification address is always irrelevant, and if it doesn't match the order details, I suspect the seller won't have a leg to stand on (not least of all because eBay reps have advised that you don't have seller protection with eBay if you make a minor adjustment to eBay addresses, like change the suburb, which many sellers have to do on a daily basis when buyers put things like "Sydney" in the city field, but not their actual suburb).

she knew what she was talking about because after i finished with my problem  i then asked because of that time the ebay address had number 122   and the paypal had 124   even though its only next door , but could of been 224 or what she said as long as you sent the order to there ebay address you are covered  or if you sent it to there paypal address .  everything she said with my problem was fixed whith the job getting done she also said my problem would be fixed within 5 minutes and bang it was done , she knew what she was talking about sounded like a very experience person who has been there a long time.
