Unjustly banned from selling with unfounded allegations

Hi, I'm in Australia and been selling for 10 years.

100% positive reviews, refunded when needed and so on. Really went out of my way to be a good seller.

 

1 day I was restricted from selling and asked to prove I have delivered all my sold items.

I did this with customer reviews, tracking numbers and photos of items and buyers property.

 

Then they accused me of being linked to another account, I asked for proof as I haven't herd of this account and they quickly changed to asking for receipts of the items I'm selling.
I provided this and they permanently restricted my account from selling.

I keep asking how I'm linked to this other account and they say they can't share that info due to privacy....
Makes no sense. if they are so sure it's my account, why can't they give me the details? To them it's giving my details to me!!!
Is it because they have the same name as me? do they have the same address as me?

They won't let me prove how I'm not linked to this account because I don't know how I'm linked to this account.

Went to the ombudsman and as this is a privet company they couldn't do much and advised to seek legal advice.

 

Has any 1 got some pointers on what legal services I should follow up with?

I feel your pain, that would be so frustrating! It sounds as if you have been unfairly targeted.

 

I don't know that you will get anywhere with ebay, I have read of other people in similar positions, banned from selling. From what i recall, very rarely were they able to get it reversed. I've only read of one case. There may be others, of course, that I have never heard about.

 

You're asking about what legal services you should use to follow up. If I were you, I'd have a good look at past sales and profits to see if it is actually worth it as legal services can be massively expensive & you'd be up against ebay, which has deeper pockets.

 

I have also heard of other people who were banned from selling and who got around it by opening a new account, on a different computer or device not at their home. But they would have had to have accounts that didn't link to the same address & I presume not the same bank accounts etc.

If you tried doing this at home, the IP would just show up. It is all a lot of bother, unless you happened to be changing houses at the time of the ban.

 

I think your best bet is to look at the categories on Facebook marketplace and try there.

Or if you have a specific range of items, see if there is a facebook interest group for them where you could sell to the converted.

Hello,

 

A couple of questions for you:

 

1) Does anyone else at your street address have an ebay account? This would be enough for ebay to say your account is linked with another. 

 

2) Looking back over your sales for the last three months, particularly the higher value items, is there any possibility that one or more of the items were reported to the police as stolen? 

 

Ebay's actions are draconian but necessary to maintain the integrity of the site.

You are asking about legal services,   in reality, what can they do,  it is up to Ebay to decide who does and who doesnt list items on their platform.

 

Sure it may be unjustified that they have banned you, but its their decision.

 

PS.  are you sure no one else in your household or work environment are doing anything dodgy to raise the suspicion of Ebay.  We all trust our partners, kids, extended families, and of course our co workers are perfect, But ...............

have you had any visitors to your home that have accessed your wi-fi?

 

Have you had any buyers do pickup and allowed them to log into their eBay account on your wi-fi while collecting their item.

 

Do you share wi-fi with a neighbour?

 

Is your wi-fi connection secure and password protected?

 

eBay may have noticed other eBay accounts using your IP address.

The best you can afford, but that most likely won,t be sufficient.

Your account can be reviewed at any time, and can be triggered internally, or by a number of external agencies.  If the later, it can be illegal for ebay to provide any information to you.

 

Re your account being linked to another,  this can relate to family members,( close & extended), friends, associates and even work colleagues.    It is not even restricted to associates or trade in Australia, and depending on who is looking, being restricted from selling on ebay (which can also be directed by external agencies) may be the least of your problems.

along the same line of thinking, have YOU accessed your eBay account using someone else's wi-fi?

 

Have you used "free wi-fi" at a business? e.g. Cafe, hotel, motel, library

And all those sales have now disappeared.   I don't think  selling will be resuming.
