I am re-selling from a wholesale fashion in Asia, ofcourse. I am using their pictures in my listings( for which I asked permision) and also the description of the item as accurate possible from their listing and sometimes measuring myself to avoid problems.
Started this little venture 23 nov., went well, till one of the dresses started a snow-ball of money back requests and negative feedback ''offers''. As i lost mu full use of my body due to an work accident I have to look in doing something to bring some extra money for rent, bils etc as a single parent, si I can't lose credibilty as a SELLER.
What can i legally do to prove that Iam not ''misleading'' buyers in my description or ''sell something totally different from the listing picure''? hope you can understand the frustration of being called..names when I AM SELLING THE PRODUCT ON THE PICTURE WITH WHOLESALER DESCRIPTION! NOW I HAVE MONEY HELD ON PAYPAL AND OPEN CASES THAT I AM SELLING FAKE STUFF. COULD NOT BELIEVE.
ALSO, PAYPAL CAN HELD AND RECUPERATE FOR BUYERS WHO WHERE NOT VERIFIED AS BEING RIGHT, BUT WHAT ABOUT MY UNPAID DRESSES I SEND AND JUST A LOUSY LISTING FEE?
PLEASE, TAKE A MINUTE TO THINK!!!!
P.S. CAN PROVE TO ANY LEGAL AUTHORITY THAT I AM NOT IN WRONG HERE, BUT PAYPAL....NOT SURE.
ANY FEEDBACK ON SUBJECT WELCOME!

The real products don't always look like catalogue photos. It's better adding own picture of the products.
About the white maxi dress with negatives, the catalogue photos aren't good enough to describe the dress. It need photos for how back looks like, close-up shot of how the bust area looks like. Because it's white you can't really see details of the dress.
It need measurements for length as well as bust and waist.
I have realised you have added the real pictures of the item in your hand in your new listings. I do have to agree to the buyers. Those real pictures don't look like the dress in catalogue photo. From the catalogue photo, I imagined a zipper fastening on the back. There is no mentioned about how back looked like in the previous listings.
You need to make own description according to what you have in your hand. Asian supplier's descriptions aren't always accurate. (From my experience)
About the PayPal dispute, If the PayPal found it as item not as described in favour of the buyers buyers have to return the items to you before they get the refund. So you will get the item back. Then you can apply cancellation to get Final Value Fee back. You still have to pay listing fees.
And one more thing. You might want to consider starting a new ID rather than keep going with your present ID. You have only 11 feedback score. So you won't lose much. Plus your DSR is very low in description. It will be very hard to get it back up again.

Just thinking, do you have all of the items your selling at home with you or once you sell them do they then get shipped from overseas?
Do you actually see the item your selling?
It sounds like your using the catalogue pic but the items arent being sent by you, they are being sent (drop shipped) from your overseas wholesaler, and if this is the case then yes things can be different.
I know from ordering some things from one of my wholesalers, not from china etc, from USA, and sometimes what i order isnt the same item as in the pic, its the same sku number, but the item is different.
i think this might be happening with you??
If not then do you unpack your things and actually look at them to make sure they are just like the picture?
If not you need to.

You can try lodging a claim of defamation.

but syrup's advice is best....start over with a new id and definitely take your own photos. Even if you have to lay them on your floor it's much better than using stock photos.
Just a thought now...
Did you take delivery of these items in sealed plastic wrap and not check them before posting ?
Cheap asian clothing has every possible corner cut and you do get what you pay for.
You have also picked one of the most price competitive items on ebay. You can get items like these delivered for FREE out of Asia that will still undercut you.
All the very best.

I should learn to type faster SHC.

I've just checked more listings again since SHC mentioned dropshipping. I've realised you have another listing for the maxi dress with supplier's info photo. So the new pictures you added is from catalogue as well.
If you are dropshipping you can't know what buyers actually received. It is out of your hand. But you are the one take the blame because you are the seller.
If you have one in your hand and you are the one posting you need to focus describing the item well so buyers know what exactly they are buying.
Those buyers bought the item with the first photo without the second thought the real one doesn't look like the one girls wearing. I can hardly tell those are the same dress from the first photo because the first photo doesn't show any details.
Considering the price of dress is so low with free postage I wouldn't expect very high quality dress but it looks much nicer in the first photo than the second.
I started to sell on eBay a few years ago because I was a home bounded carer could use extra cash for family. I found selling on eBay is not as easy as it seemed. There are walls everywhere to bump into.
In the early stage of small business it is very important to have good customer service. I have had some troubles with items so many times in past. But I offer refund for return if buyers aren't happy about the products. I treat my buyers as I want be treated as a buyer. So far I haven't got any PayPal dispute. And surprisingly those customers do return to my store to buy again because they know I will do the right thing if something goes wrong.
I strongly recommend you to start fresh with new ID. Learn to use photobucket and html to put pictures in your description so you don't have to pay for extra photos. Put more details in your descriptions.
If you have any questions, this eBay forum is good place to ask. There are always many members here to help you.
I hope you sort things out ok. Good luck ๐

Sympathies to you for this problem.
It's a common problem with stock photo's and in recent times (the last year or two) there has been a trend in manufacturers to lessen the quality of products instead of increasing prices but they use the same photo.
You just have to work around it.
I'm sure I have lost a few sales because my photos are not as professional as some, but honesty is the policy.
Cover yourself by keeping up with your product lines.
Best of luck.

Never ever take a photo of an item on the floor especially clothing.

So Tupper is it better to use a stock photo of an item you don't have or take a photo on the floor of an item you do have ?
I was simply stating that any photo of an item in hand is better than a stock photo of an item you don't have in hand.

Anyone about to sell a piano please ignore tupper's advice about not photographing items on the floor.:^O
I think if a person puts down a very, very clean, thread and fluff free fabric on the floor to photograph items for sale it is OK.
However, do not lie the items directly on the floor because most buyers are turned off by stained tiles, fluff full carpet with a stain or 2, or if you catch the dog walking by as you take the photo.
I used to have problems with a grey half moon in all my floor photos until I realised I was photographing my stomach.
