When the item didn't arrive by the due date I requested a refund. The tracking number was then replaced with another persons tracking who lives in the same area & stated delivered. I obtained documents on who the tracking number belonged to, yet eBay will not act, closed case twice & then sent to back office & didn't reply. I have proof of fraud & theft but eBay is not interested. Currently going through Fair Trading NSW but they seem just as useless. eBay is facilitating fraud & theft & have no intention of protecting the consumer!

how did you pay?
If you paid by credit card then contact your card provider and initiate a chargeback.

Please let us know how you get on.
I have read of this sort of thing happening to other people too. I don't think it is very common, but it does happen.
You can leave negative feedback but be very careful how you word it so that the seller cannot get it removed.

I did, they referred back to eBay saying that the item states it was delivered!

Went via Fair trading NSW but had to push it, they didn't seem to interested as well. eBay gave me a refund! It took 3 months & as far as Fair trading is concerned the dispute has been resolved. I'm really upset that this has been allowed to happen & wonder how many people it has happened to. Fair trading NSW doesn't seem to want to enforce or forward any information on the matter. I told them that I would be pursuing this & that the refund given was an admittance of liability, yet the toothless tiger hasn't replied!

I am impressed that you did push it. The fact that ebay gave a refund after 3 months says to me they were probably contacted by Fair Trading at some stage, maybe for details, and decided to follow the easiest path.
You would think it was an admittance of liability but it isn't always. I used to work at a school and our prin told us that anyone who brought a case against a school, the Department automatically made an out of court settlement, whether they thought the person had a strong case or not. It was easier than contesting it. We were talking at the time about a ridiculous claim someone had made when they were not even in the school.
In your case, the refund was well deserved. I can understand that okay, ebay sees a tracking number and information that the item has been delivered, they may automatically side with the seller. They hate to involve humans, they try to do everything with Bots.
But once a human was contacted, if they looked into it and saw that the tracking address was not to you, then I think the seller should have been put on notice.

You got your money back. Now you can purchase from a reputable seller, with the advantage of knowing what to do if things go south.

You have my admiration, many have said they'll do this or that you the first I've heard who actually did. I'm not confused as to who the tiger is.
Fair trading probably did contact ebay. Not for any specific case, but rather to warn them at an organization level to keep the complaints below a level which would require their intervention.

There have been a few people over the years who have complained on these boards that it happened to them but I don't think it is all that common.
I can't really know though. I'm just going on posts to the board and very few ebay users actually post on the boards. It is not a common complaint here, at any rate.
But it can't be an easy scam to do, or I would not think so. To give a false tracking number that actually goes to the same suburb, but to someone else.
As for forwarding information, they all seem to be worried about privacy issues these days. Ebay rarely seems to give out any info either.
