Can a seller refuse a refund once item has been sent back

Hi

 

i purchased a used boat sounder which was described as perfrect working order. Received hooked it up and it cuts out and turns off. Concted the seller stright away asking for refund as faulty. They replied that it was working fine when posted , offered 50% refund then after refusing saying i want a full refund keeps denying there is an issue saying it was damaged in transit, working perfect when left etc. 

Im insisting on refund. Said I need to post back before they will refund. 

My concern.. if i send back can they deny my refund?? Im worried he is going to say ive damaged it which i totally havent its was $600 **bleep**.

 

Any advise is greatly appreciated.

Open a case for INAD in eBay and the seller will need to provide a return label if they want the item back. (Only in Aus)

Follow the case through to get a full refund.

Thanks Kopenhagen5 - I have started the return process this but im just worried once ive returned and he has got it back he will refuse the refund trying to say i have damaged it.

eBay side with the buyer 99% of the time (even buyers who are on the dodgey) so it is not up to the seller if the give the refund or not really, so long as you follow the correct procedure with the item not as described case, through eBay and don't let the seller 'talk you into' anything you are not happy with

Once the seller has the item back, he cannot keep both the item and your money.

 

You can ask ebay to step in if he gives any trouble.

 

Ebay will refund you, and get the money from the seller.

 

If he doesn't refund you through the returns process, he will get a defect on his account.

 

He must provide a label, and it must be sent back by trackable means.

 

Upload the tracking number to the dispute.

Thanks everyone for the advise 🙂 i will ensure they approve the return before sending and will get ebay to step if if they try to withold the refund.

Once you open an INAD case, ebay place a hold on the money in the sellers paypal account ( assuming there is enough money in there ). They can also take the money from the sellers bank account if need be. If the seller has taken all of his money from his bank account, ebay will cover the cost and make life VERY difficult for the seller, blocking them from selling anything further on ebay and chasing up the money owed.

 

As others have said, return the item with the sellers postage label or TRACKING if they dont / wont provide one. NO tracking number, NO refund, no arguments.

Hi banga1988,sorry to hear of your dilemma.  You have to make sure that you always maintain the upper hand. There are 2 kinds of problem sellers with situations like these. The first type is just dishonest and the second type is the one that refuses to take responsibility for their stuff ups. It's probably the case of you not so much dealing with a fraudster, but more one that refuses to take responsibility.

 

You are entitled to .... 

* A full refund of the item cost.

* A full refund of your shipping cost when it was sent to you

* A full refund of your shipping cost sending it back to the seller.

 

And with the complication of the GST etc, make sure that's refunded to you as well (If it was an OS purchase)

 

I've been caught by buying of a seller who basically sold me worthless junk (In re-sale value), dishonestly / grossy negligently graded the item and I was going to out of pocket bothways on post cost, having  to send the item back for a refund. In a once-off compassion gesture, PayPal stepped in and refunded me.

That US seller (r _ _ _ _ _ _ _ t) was a high volume record, memorabilia seller who has the (I'll deflect the fallout) bad attitude.

The item was advertised as a near mint 1970s Hi-Fi booklet. Item recieved was nothing more 4 pages pulled out of a magazine that was possibly from a doctors waiting room. Well read with finger nail creases all over.  Horrible experience.

 

Good luck with your quest. I hope you get back every cent you have put into it. Sadly for you, the hassle, stress and time lost will never be refunded.

Chameleon54 it doesn’t matter if there’s funds in the sellers PayPal it will just go into a negative amount. Next time the seller receives money it goes off the negative amount until it zeros out or if the seller adds funds. If they use the account to buy the negative balance must be zeroed out before a purchase can be made. They can’t actually take it from a bank account but it essentially freezes their ability to sell until the matter is resolved.

You are correct with everything above including that paypal cant take money from a sellers bank account unless the seller has agreed to it.

 

I was reffering to a bank account or credit card linked to the paypal account as a preffered payment method. ( I should have clarified that ) The way I read it under Paypals user agreement, sellers agree to allow paypal to take money from linked bank or credit card accounts to bring a paypal account into credit.  Please see extract from paypal user agreement below

 

Amounts owed to PayPal

If you owe any amount to us, our affiliates or eBay you agree to allow the recovery of these amounts by debiting your account promptly after we form a conclusion on reasonable grounds that payment will not be received in full for any reason.  If there are insufficient funds in your account to cover any amount you owe us, our affiliates or eBay, the amount becomes immediately due and payable by you and you authorise us to satisfy any of these debtsby:

  • Debiting your account at a later date;
  • Debiting a preferred payment method;
  • Setting off the credit balance of any account you have with us or any monetary liability we owe you and towards satisfaction of your debt; or
  • Any other legal means.
