Hi all ,
Bought a set of binoculars that are defective , I did ask the seller before buying if there were any optical issues , got a message back that stated they were clear to look through ~ went ahead with the deal .
They turned up with a seized focuser & diopter plus internal haze ' useless condition to use .
Tried twice to contact the seller got no reply .
Have tried to get a refund through eBays fill out a request but get as far as this message ( This seller does not accept returns for this ) so I'm stuck it seems ?
Anyone know how I can proceed please ๐

If you're within the time limit, file an 'item not as described" claim through eBay's MBG
https://pages.ebay.com.au/ebay-money-back-guarantee/
Failing that, if you paid by Paypal, you have 180 days from payment to file a claim
but always try an eBay claim first

That is what I did ~ ticked item is defective then after filling out why I got the ( Seller does not accept returns ) answer.

Are you outside the 30 day limit for a dispute ?

Were they listed for parts or repair

I'm inside the 30 day limit .
They were listed as working fine .
Shame I just can't easily contact eBay to get this resolved .

It sounds as though you tried to use the change of mind return process.
You must use the returns process for Not As Described. Iโve copied the information below from the MBG help page posted earlier.
Sellers are required to deliver the item as it was described in the listing. If the buyer receives the wrong item, or the item arrives broken, damaged, or faulty (and was not clearly described as such), they are entitled to return it for a refund, even if the seller doesn't offer returns.
Buyers and sellers may agree to another solution, such as a full or partial refund while the buyer keeps the item, or a replacement item instead of a refund.
Both buyers and sellers must meet all applicable return requirements. If an item is being returned, the seller is responsible for return postage.

Is the case still open ?
If yes, have you asked eBay to step in ?
You can contact eBay by using the Help button at the top of the page and when you get to the automated chat, ask to speak to a supervisor

If the item is not as described, the seller does not get a say
They can only decline to accept returns if you selected change of mind
