There is no point in yelling at us.....we are only volunteer members who try to help with problems.  Ebay staff do not read or respond on the boards.

 

First things first.....ebay do not give you your money back.  You need to make a claim through the paypal Resolution Centre.

As the item was listed in the wrong category which is not covered by paypal protection I suggest you RING paypal and tell them that the item was not a car or real estate but was listed in the wrong category.

 

It may not work but it is worth a try.  And rather than be belligerent and rude I suggest you curb your temper and speak nicely to the representative on the phone....after all they are not to blame for your predicament and you want them to help you.

It was a scammer's listing, specifically listed in one of those categories for that very reason. I'm surprised the OP truly believes he can buy a 7" wireless intercom for just $29 and he should have known better. Still, it's a bit rough when Paypal use that clause to get out of having to refund the buyer's money and I'd be lodging a dispute with the Ombudsman and making sure I got my money back.

Where is eBay's duty of care anyway? They knew it was a scammer yet they allowed the listing to sit there long enough to catch out the OP and God knows how many others, all of whom now run the risk of losing their money because eBay didn't do their job properly. Their usual comeback of "but we're only a venue" is starting to get a bit old these days.

Yes CQ, I am aware of the circumstances of the listings....this is not the first threads we have seen on then boards.

 

It was always a matter of time before other buyers came here.

 

But as I see it, there is no point in calling in the big guns before appealing to paypal politely first.   They may just surprise us all.

Have you read the latest on the thread where the seller issued a partial refund and expected the bracelet to be returned?  Against all odds paypal refunded all her money as a goodwill gesture...and I am talking hundreds of $$ here....not a paltry $30.00.

Absolutely agree that Paypal will do the right thing in the end if you are persistent enough. If it was listed under motor vehicles then I should think Paypal will have automatically have sent a not covered response and if that is the case how can they know any different if the buyer doesn't let them know.

 

Give them a call, be polite but firm, ask to speak to a supervisor if you aren't getting anywhere and if still no go tell them that you will be contacting the FSO if you are not refunded within 48 hours.

 

If I had found a listing for anything other than a car in the cars category I would have reported it rather than buy it!
