EBay Keeping Unsent Item

Hi. I’ll try keep this short. 


I purchased a particular vintage (40 years old) Ni-Cd battery from overseas. It’s rare, very collectable and in new condition as this was, it is impossible to find another the same. 
This is not a dangerous Lipo battery. It’s Ni-cd, small only 1200mah and about 16cm long by 5cm. These are sent all over the world everyday. 

The seller sent item to EBay for them to take care of shipping. 
I get a message a week later that item cannot be sent because of battery restrictions and I’m being refunded. 
Turns out Seller got his payment and EBay are not sending the item back to the seller. It will be kept by EBay shipping. 
I have a big problem with EBay doing this and not returning the item. 
I know the seller.  We wanted to keep this item ownership between us. Also, it is irreplaceable and we want it back. 
I have contacted EBay and they will not send it back. 
How do we know someone at EBay shipping didn’t fancy the item for themselves and simply marked it as not sendable?

looking for advice on what we can do.

You didn’t see any real facts that I gave hey? Do you see my item on a proper prohibited list? Hmmm did you ignore the fact EBay should not have allowed me, the buyer to purchase the item if  it could not be shipped?

Mate. There were no accusations by me. You need learn the difference between suggestions and accusations. I said it was possible. 
You and others here still don’t get the point. You say everyone got their money back so no loss. 
Read what I wrote at the beginning of this topic about what this item is. 
Also, as per their guidelines, EBay should not have let a buyer purchase this item if it cannot be sent to them. And you all still persist I am at fault.

So EBay should not have allowed me the buyer to purchase the item to start with if it could not be sent.

As the importer you are at fault, believe it or not. It  is restricted not prohibited.  If you as the importer had ensured all requirements were met, then the item would not have breached restrictions.

Next time you want to import hazardous materials/dangerous goods, do some research as to what is required.

You went in blind, and the item got seized.

  • Hazardous materials banned by a selected delivery provider (Sellers should check with them before listing an item.

I know it says seller, but also as the buyer hence importer, it is also your responsibility to check the item can be shipped to you.

Now, follow your nose for restricted shipping of hazardous goods, both national and international.  Not going to provide further info.  I  am really tossing up if to lead you all the way to the most comprehensive sources, but figure I have already given you the comprehensive answer, which for some reason you don't accept,  maybe because I broke it all down for you and eliminated everything that was irrelevant to your item. 

Anyway, better luck next time, because this particular item is gone.

You may be right in that the type of battery you bought can in fact be sent to Australia. I wouldn't know for sure. Some items cannot be sent by air though. And there could also be further restrictions on how an item like this has to be wrapped etc.

The problem, as I see it, is you are subject to the interpretation of the rules by the individuals working at the GSP or for that matter, at a post office. Or those working in customs if an item like this came through.

 

Ebay would not have the item, it would have been confiscated at the GSP centre. If the people there have deemed it a prohibited item it seems they don't return these. I'd say that their opinion is it should not have been sent in the postal system to them in the first place, so they are not about to post it back, breaking their own rules.

 

At least you got a refund. Look on the bright side. Had it been seized by Australian customs, you may not have got anything. No item & no refund. That's because the ebay money back guarantee doesn't cover items that don't make it through customs.

Once again, you the buyer are responsible for knowing what you can and cannot import and how

 

eBay have no idea who you are, not a clue

 

How do you figure eBay can 'stop you' from buying?

Why are NiCd batteries banned?
 
 
Nickel cadmium batteries have been pretty much outlawed for consumer use in many countries due to the toxic metal cadmium used in their manufacture. Within the European Union and much of the rest of the world, their use is restricted to specialist industrial, medical and emergency lighting use.

Your link does NOT show Ni-Cd or batteries in general listed anywhere. Also, I cannot find anywhere in the GSP terms that state they are restricted. 
It’s a bit weird that you posted that it’s there and claim a “comprehensive” answer but no copy or link to support you. Can you show me a direct link where it says so?

Also. You keep ignoring the fact EBay state in their terms that they will not offer an item to a buyer if it  cannot be sent to them.
