How do I find out the vendors real identity and address so I can sue them for breach of warranty? On 26/3/14 I purchased a S/H

<Removed>The machine arrived on ~8/4/14 filthy, water reservoir cracked/useless; I immediately complained to vendor via eBay but received no response, so I purchased a replacement water reservoir from UK which by now doubled the purchase price. On 7/8/14 I powered the machine up & it immediately pumped dirty boiler water into the waste tank and would not pump through the drinks spout. EBay claims the transaction is closed, I don't think so, this vendor should be responsible and pay compensation for its breach of the the Australian Consumer Law warranty of fitness for purpose.

Did you fund the payment with a credit card?
If yes then call your bank about doing a chargeback.

Instead of buying a replacement part you should have immediately opened a paypal dispute if that is how you paid for the machine.
You only have 45 days to do that.
Even if you funded the payent with a credit or Visa debit card you may well be out of time for a chargeback. Many banks are now allowing a shorter timeframe than previously.
What warranty was promised by the seller? You do realise that unless the seller is a registered business and authorised reseller of the item there is no manufacturers warranty on most goods on ebay. And no warranty on used goods as this machine obvioulsy was.
And where did the item come from....that seller was originally registered in Germany so Australian Law means nothing.

SH electrical goods are not covered by any Aust Consumer law
you had free Paypal Buyer Protection for 65 daysfrom date of payment, ie 45 to open and a further 20 to escalate.
this is a FREE service to all ebay buyers, you decided to not claim then, so you cannot say 5 or 6 months later...errrrr yeah I do want to claim.
you must claim within the correct period.

Do you mean the above only applies to electrical goods sold on eBay?
