Hi everyone,
basically I am the buyer for my problem, I purchased a ~$500 item (graphics card to be exact) and unfortunately my item was safe dropped as I had left my residence since the tracking didnt show out for delivery, however suddenly the next morning the tracking has 2 entries, one was out for delivery and the other delivered...
Unfortunately when I contacted the seller, they immediately attempted to cover their own back-side and started accusing me of being a scammer, swearing at me violently and lashed out at me. I have already reqested for Auspost to open an investigation, however they said there was not really anything they could or would do, as it wasnt their responsibility to cover loss since there was no SOD and/or insurance purchased by the sender.
Is there anything I can do? as paypal says that I cannot win this case since the seller has the tracking and some sort of supporting document.
I also have a thread on a different site, but unfortunately have not been able to get much information from it

Thats good to hear.
It truly is always worth a call back, or request to speak to a supervisor, if you do not get a satisfactory answer from a paypal agent or eBay rep.

Very observant but I wouldn't read anything into that. For 5 years I travelled 45 minutes to another town for work every day and that is where I posted my parcels in my lunch hour. There are lots of ebayers who have a full time job besides ebay so they don't necessarily post their mail in their own town.
Yes, beach, I agree with what you say, but i was just pointing out that it was another in a line of odd things that have happened with this transaction.
I am actually a bit surprised that paypal did not close the dispute in the OPs favour immediately. Every time I have pointed out an invalid tracking number my refund has been processed while I am on the phone.
I am amazed that an item shown as being delivered within 15ks of your suburb is considered acceptable. Putting that in perspective for my own address...I Iive near Mascot airport, so a package could be delivered anywhere from Mascot to the Sydney CBD and still be acceptable to paypal.

I see, hopefully the seller wasnt actaully trying to scam me and paypal refunds my payment from their own funds if the seller was legitimate/\.

If the parcel has been stolen after delivery and the Seller is unable to provide proof of postage which meets Paypal's requirements then it is the seller who will be out of pocket - not Paypal. Even if the seller is legitimate they will still have to pay for it.
Lyndal - I am not sure how you can say it is an invalid tracking number. The tracking number alone may not be enough for Seller Protection but that doesn't mean it is invalid.

Jen, the number is invalid for the purposes of paypal protection. It does not show the OPs street address or postcode...just a suburb.
If a parcel was delivered to my postcode it could have been delivered in any one of 4 suburbs, so just a suburb or postcode in isolation is not sufficient for paypal.
I used the term "invalid" simply because that is what a paypal representative used when I had a dispute involving a similar scenario. I queried that it was invalid because it did show a suburb (not my suburb but a nearby one with the same postcode) and the rep assured me that it was invalid for paypal protection purposes.

Sorry guys I realize that this is a bit off topic, however is there a way to block messages from the seller? As the seller is constantly sending messages accusing me of being a scammer and then saying that it was not his fault and that he was simply mis-informed (basically contradicting himself..), while I can deal with that, his messages make it seem like he is a teenager and he is swearing at me constantly and eventually I fear I may end up making some sort of violent response that could be used against me.

No, if you have a current transaction with a member you can not block their messages.
I reckon just report each and every message to eBay using the report link that is up at the top of every message (where all the message menu buttons are).
IMO report the messages, then ignore them and don't respond in a hostile manner.
