TOS are ridiculous - if you only post on a Friday - all well and good, but most people would assume if Friday is a PH then you would post either Thursday or Monday.
No excuse for shoddy customer service and one wonders what the seller would do if you were to say you could only pay on a Monday (lots'n'lotsa Monday PH's)

Yes, the seller may have listed all this info in her FAQs, however they should have sent a quick email to any buyers as a courtesy.
If a simple message along the lines of :
“Thanks for your purchase, just to let you know as per stated in my FAQs, I can only post on Fridays (due to ______). As this coming Friday is a Public Holiday, I will be unable to post your items until Friday 5th April.”
the buyer would have been reassured and the delay in postage wouldn’t have been an issue.

No issue if the seller communicates this. The seller has not stated a time frame. Lack of communication is the issue. Their terms state 'I Only Post On A Friday (the exception to this is any public or school holidays)' doesn't tell me if they will post on another day instead or not post at all on these days. If you have the ability as someone with a disability to create a listing (especially with such a long list of terms) then you have the ability to communicate your expected postage date.

The seller has stated that they post on Fridays that aren't public or school holidays. Your interpretation, imo, is trying to nail them to another day of the week. Which is your interpretation and, I suspect, not what a court of law would deem a REASONABLE person's interpretation.
eg My interpretation is that the item will be posted on the first Friday after payment that is not a public or school holiday.
Which way would the judge go? It depends, I suppose, on whether or not the judge understands the term 'reasonable person'.
I haven't even looked at who the seller is, but I'm fairly sure who it is, and I think the lot of you should pull your heads in.

How come whenever someone disagrees we pull the 'court says' crap. How about just being decient sellers/buyers with no ulterior motives! To much to ask????

Wasn't really clear to me. Said 'I Only Post On A Friday (the exception to this is any public or school holidays)' doesn't tell me if they will post on another day instead or not post at all on these days creating a 3 week wait before easter. They also have Estimated within 6-11 business days in their post times which will clearly not happen for this sale. They buyer has a right to be worried. If the seller cannot post for over 3 weeks from the end of an auction then they should not list...in my opinion!
Im not sure what isnt clear about this sentence: I ONLY post on a Friday.

I was just trying to establish a baseline.
Okay, forget the courts and 'reasonable person' and disability. Lets say you, as a seller, live in whoop whoop. You go into town once a week, but you rely on your neighbour 10k down the road to give you a lift to town (probably because you went DUI too many times). Your neighbour doesn't want to go to town on public holidays because everything is shut. They also can't go to town in the school holidays because the rugrats are at home and they have to try to stop them destroying the joint.
Would you -
a) Expect a buyer to be sympathetic to your situation, especially when all this information was in the listing;
b) Expect the buyer to expect you would post next day, regardless of the impossibility of this;
c) Try to be a typical member of society, regardless of your personal circumstances?
The consensus here seems to be "If you can't post within a day of the sale then get off eBay'. Very inclusive. With no ulterior motives.

Non of the above!!! I am a mum of 10 with 1 severly disabled... live in the middle of no where... but would expect communication! NEVER said post with in a day but at least let a buyer know your expected post day before they ask 11 days later. Just common curtesy with out judgement!

I've read the sellers TOS & no way would I buy from her-what a horror.
Cat hair,unwashed & unclean clothes,demands payment within 3 days, sarcastic follow up to neg,won't give address to buyers after they paid etc etc etc.
Having an alleged disability is no excuse for rudeness or ignoring ebay policies.

That's not really the point, foxie. The point is that the seller states they post on Fridays, unless that is a public or school holiday. As such the buyer needs to pull their head in, as the seller has not yet breached their terms.
