Are "out of stock" items allowed to be listed ?
There are many listings which state "out of stock" just curious..
eg,
252293715137 $999.99
262324863180 $999.99.

Store holders have an OOS feature which they can use so the listings are still visible.
Normal accounts don't have that feature so many members keep the listing active by setting a very high price until they are back in stock.
Not the best way of doing things but I guess they will continue until eBay make an OOS function avail for all.

Yes I would haha,
I bought an item once for $3K that was out of stock just to see what would happen and I ended up getting a refund
as the seller advised me that it wasn't in stock and the price was just a deterent so no-one would buy it.
It was just to prove a point that ebay shouldn't allow this out of stock policy.
I asked kopes what would happen in this situation but I already knew just to get someone else's perspective on it.

If someone purchased an item of me that was at a highly inflated price of $3000 as it was out of stock I would hunt high and low until I found one and send it to the buyer.

Why - If an item was out of stock yet somebody still purchased it but I was able to source it elsewhere why is that being dishonest?
Just so you know - I use the Out of Stock feature on my listings so don't inflate the price if I am temporarily out of stock.
