Please help, I'm at a loss.. What options do I have, if any??

I won an auction for 3 concert tickets. I was going through some **bleep** & they buyer agreed to let me pay in 2 instalments. He didn't want me paying by PayPal due to fees being taken out (yeah, you can see where this is heading). He agreed to lower the cost of the tickets by $145.

Upon winning the auction, he sent me an invoice he got for purchasing the tickets from the Sydney Opera House.

I paid by bank transfer. 2 payments of $650 in total. I provided him with receipts of said transactions. Now he's saying that he only received $200.

....In his last email he stated:
"I today received an invoice from ebay for $103 for the sale of the morrissey tickets to you however still no sign of $450 or anything further from you (including an email) other than the $200. I have to tell you I have no money to pay my credit card bill let alone the ebay bill and am beginning to wonder whether you have even transferred any more than the $200. I am letting you know that if I do not receive the additional $700 balance in my account by close of business Thursday I will cancel the sale and return $97 to your account subtracting $103 to cover the cost of the ebay sale and my losses.
IF I receive the FULL amount of $700 in my account by COB Thursday the tickets remain yours and I will cover the cost of the eBay sale."

I then contacted eBay & was told that I should not have paid via bank transfer (yes, I know I am stupid, please don't tell me something I already now. I was stupid & desperately wanted these tickets). I was also told that the conversations should've been done through eBay, not me replying to his emails (no. I didn't know this).

I messaged the seller on eBay, replied in length to wrote he wrote & stated that he couldn't cancel the auction & keep my money, & that I will be opening up an investigation with my bank, which will take 10-15 business days. No reply.

Thursday has come & gone, he's still not replying, hasn't sent any of my money, nothing... Ebay have said that they're trying to get in touch with him.

What do I do know? Is there anything I can do?!

Yes I know I was stupid to pay via bank transfer.. It was a rather daft thing for me to do. What I would like to know now, is, what (if anything) can I do? Should do? Or have I lost my my money as well as the tickets...?

The seller of the tickets has a lot to lose here if what Joe says is right (and I am sure it is). If the tickets are riskier to buy after the 24 April, then that brings the price down and the seller isn't sitting on such an asset any more.

 

What it basically comes down to is the seller should have insisted on all money upfront or else opened an unpaid items dispute straight off. From what I can see, all this payment in dribs and drabs hasn't paid off for either the seller or the buyer. At a guess, I would say that neither one of them has confidence or trust in the other now. And the buyer is out of pocket too, with nothing to show for it.

 

I understand the buyer's dilemma but the lesson here is no matter how much you want something, go without, don't bid unless you have the money to pay for it and can go through the normal ebay transaction channels. It's a real mess. I would love to find out how it all pans out eventually.

not confused tickets are up for sale as we speak , hope for the seller he gets a good price , [ funny as the buyer has not come back and said they found the mystery $450 MMMMMM   have a nice day all

Post 35, from the buyer, states that the bank verified the seller received the two bank transfers, Joe. The total of 650$.

All that they said they had transferred to the seller. Not the whole amount owing.

hi amber the arangement was for 2 payments totaling $900 by the 24th  ,even if she says she sent 2 payments totalking $650 ,she has broken there agreement , and now the seller is u the creek ,these tickets are not worth as much now , and they are up for sale , from 4 days ago and still no bids at a starting bid of $600 , if she pad for them ,they would not have been for auction now.

[as I said to all of you except for a few , she cant go to the police because it looks like she is the scamer.mmmmmmmmmmm

let me explain in english the seller did not get 2 payments from the op ,thats why thise tickets are up for sale on ebay now , as i said , if the seller got the money in question , he would not be selling them on ebay now , the reason they had to be paid for by the 24/4 is the tickets would come direct to the op from the sydney opera house , thats why the big price ,and also good seats, so the tickets become more genuine, now this poor seller with a feedback score of 2 ,is trying to sell them again ,forget the $1045 they went for , a lot of buyers cant be sure if the tickets are a scam now ,as tickets now will come from the seller not the sydney-opera house.  lets hope he gets a good price, you never no

because posters are saying the poor op loosing all that money , and i am answering posters that say i am wrong,

posters are saying to the op .go to a police station ,what sort of advice is that .mmmmmmmmmmmmmmmmmm pleaseand posters saying the op should be calling the federal minister..  please......................................................

Joe, I did the math very early in this thread.

If the buyer can indeed prove they sent what they say, they did, the seller has more money than they say, they received.

That makes the seller potentially suspicious.

No, the seller didn't receive All the money. But the point is, they have received the "mystery 450$", you refer to.

Which had been "found", by the bank. In the seller's account. The buyer did explain that.
