Please help me.... seller fraud listing

I have paid on 9th Nov for us$4500 Chanel bag, as seller listing "this bag is RED in Nearly New; Pristine condition",  I did not take carefully look when I received the bag, but last Friday was the first time I took the bag out, unfortunately  I have see so many marks on the interior leather and outside the patent as well. Seller has never mention those marks and spots on her listing even I send her email. I hacompliant to seller last Friday but she told me i can sue oil to cover those interior marks and spots. I have asked for refund on Paypal, but seller reject for only refund within 14 days. Seller has misleading for the color on listing, the bag is DARK RED, looks much different than the pictures color you put on listing.. Seller is Not honest at all. Can someone please help me what should I do???

Honestly, photos can look so different on individual monitors so colour is always something to be aware of. I don't think this should be blamed on the seller. The bag was also listed as nearly new. It's bound to have some light scruff marks on it from being used. However if the scratches are to an extent where it's like a deep scratch, you could open up a PayPal dispute within 45 days of purchasing the item.

Was that the photo the seller used? Did you ever ask for an actual photo rather than a stock photo?

eeeerrrr this is a hard one as the bag is listed as used. pristine condition is a subjective description and will vary from person to person, so PayPal is unlikely to interpret.

 

what yopu need is facts.

 

if you have facts, you have a small chance of winning a Significantly Not as described case with PayPal, so escalate that to a claim.

 

Fact one - can you prove that the bag photographed in the listing is not of the one you received?

 

The zippers look to be different to me on the inside flap.

 

The seller specifically tells you to look at the pictures in the listing for details, but does not indicate that these are stock photos, so it is fair to assume that they are of the actual bag.

 

I do think however, the fault here largely falls with you, so a claim with PayPal may not be successful, but it is worth a shot if you are unhappy, but to me, it seems you didn't ask enough questions and wait for the appropriate responses.

 

The listing says" This bag is gently used with nearly no signs of usage" - you needed to ask what signs of usage there were.

 

Is the interior compartment clean as said? That is really the only definitive description given, the rest is simply opinion.

 

BUT, you have a chance if the pictures are not of the bag you got.....

 

but disregard colour as different monitors and cameras produce different colours. A bit of research would potentially reveal the colours that this bag was made in.

 

and there are so many different colours of red - was only one redish colour produced? or was there a few different shades of red and variations?

actually, the zippers are the same, it was just the angle of the photo.

 

Your only hope is to somhow prove that those photos are not of the actual bag which you received, IMO.

 

When reading an ADVERTISEMENT (which is what a listing is) you need to learn to read in between the lines and ask yourself what the description is really saying.

 

This bag is in Nearly New; Prisitne condition.as I said, what you consider to be pristine and another person considers to be pristine are possibly very different, especially as this is a used item.

 

 

The quilted Shiny Patent is overall soft to the touch and puffy. Is it?

 

This bag is gently used with nearly no signs of usage.This says there are signs of wear and tear - you needed to ask what they were

 

The corners and edges are in great condition . again, great is a subjective term,

 

The Silver hardware and chain strap are overall shiny.again subjective, are they visibly dull or tarnished?

 

The interior compartment is clean .is it?

 

See pictures for details! <= That there is your only escape clause IMO and colour variation will be irrelevant unless the bag was produced in different shades of red.

girl.y.pink.y I have only had a quick look at listing and have not read all the posts, but if the bag is not "nearly new" and has signs of being used many times, you can put together evidence to support your claim.

 

However - what will not go in your favour is that you have not immediately contacted the seller regarding the condition bag as soon as you received your parcel containing your very high priced item.  This means the seller can dispute your claim on the basis that they sent a nearly new bag, and that you have used it yourself or that you have substituted another bag for the one you received from seller.

 

What was the exact date that the bag delivered to you, or what date did you collect the bag from your post office ?

I agree, while I case could be made... the seller could counter claim that because of the time between reciept and your complaint, that you used it for some occassion and then wanted to return it.

Why would you leave feedback for a $4500 purchase without inspecting the item first? I think you've left it too late to complain to the seller that the item doesn't match the description. If you've had the bag since the 15th Nov you should have contacted them straight away.
