Hi ! I won an auction Sunday am and paid for it via instant paypal on Tuesday pm. The seller has just refunded my payment citing that they sold it to the second highest bidder as payment was not made within 2 days as stated on the listing.
I must admit, I had not actually read that on the listing but as a seller myself, I think this sellers actions were a little harsh. Seller made no contact with me except for a note on the paypal refund.

that is a bit harsh, after all eBay allow you 8 days effectively, 4 before seller can open dispute and 4 more to pay.
oh well I guess your Seller is impatient, and hope he does not mind getting a red dot f/back for that

Perhaps if you had emailed the seller to tell him that your payment would be made on Tuesday PM then he would not have resold your item. Just a thought 🙂

This actually sounds a bit strange to me, maybe the seller didn't want to sell the item for some reason. Offering to the underbidder doesn't guarantee a sale and would take a significant amount of time for the buyer to accept/reject and pay.
Fare enough having the timeframe and all though, harsh as it may be. Tuesday is 2 days from sunday isn't it?
I wouldn't class payment by 12:00 midnight (is it am or pm?) on Tuesday as late but I guess technically it would need to be made before the same time as sold on sunday (if 1 day = 24hrs on a shifting timeline).
Kind of like when someone orders at 11pm and expects delivery the next day with 1 day handling. I know there is a cutoff time that can be set.

I myself have experienced shorter timeframes as both seller and buyer. There can be legit reasons for this
such as seller needed a transaction sorted asap because they will be going away. Or in our case we were
moving house and stuff had to be gone (pick up) or posted by certain dates - we made it clear in the
description though.
Having learnt that some buyers don't read descriptions or don't read them properly, we put important info
like this in bold as well as at the top of the listing description and not just somewhere down the bottom where
it might get missed.

Since you had not paid, no doubt the seller made his second chance offer then.
Someone here said that can take a bit of time for a second chance offer, but not necessarily, if the second buyer logged on that morning and saw it, he or she could have bought and paid for it instantly.
I can't figure out why buyer number 1 didn't pay via paypal straight off, instead of waiting till Tuesday PM.
Actually, I think 2 days for payment sounds like a reasonable time for every purchase, except perhaps pick up.

if the seller followed the rules which they have not they have to wait 8 days before they can offer a 2nd chance offer
they can write anything in their TOS but they cant over rule ebays policy

The eBay non payment dispute process takes 8 days, but there is nothing in the rules that compels a seller to use the unpaid item process..
There is also no "8 day rule" in relation to second chance offeres that I can see.
The guidelines for second chance state: If your winning bidder doesn't pay for the item, you can send a Second Chance
That is what happened in the OPs case.
