Seller took too long to post, items now no good

Just wondering what my rights are.

I purchased 2 dresses from a seller on 26th October for a cruise that I was going on on 12th November. Seller listing says that she posts "within 3 days". I paid immediately with paypal. After 3 days with no notifications,(this was on Wednesday) I contacted seller to check telling her of my time limit.

She replied with I will post by the weekend. Still no notications so on Sunday I contacted seller again, reminding her of the time limit.

Her reply was I have been bust with work, I will post Monday.

No notifications on Monday so I contacted again - her excuse this time, my car has broken down, I should get it back Wednesday and will post then. I told her that this was no good that it wouldnt arrive in time (Melbourne to Perth) and lodged a paypal claim for a refund.

She responded to the claim on Wednesday saying that she had posted item, but when you check tracking, it says received by AP sorting centre 21:54pm Thursday so she probably just stuck it in a postbox whenever.

AP says that I wont receive the parcel until "between Thurs 13th and Mon 17th too late for me to use on the cruise.

 

I have had to go out and buy 2 new dresses to use instead. Do I have to just accept the fact that she posted 'a minimum' of 10 days after sale date or will paypal refund me.

If it had happened to me, I'd be feel pretty sour about the whole transaction, and the dresses - apart from no longer being needed, probably have the shine taken off them too.  I wouldn't feel inclined to want to wear them or keep them.

 

I think $50 is a significant figure to feel effectively out of pocket and the OP should explore all options to get her money back.

 

If paypal had previously stated that they would support a refund on the basis of very late delivery, then she should pursue this.  Of course not send them back without paypal direction.

Fair enough, but how can an item of clothing no longer be needed or any good?

 

Does the OP only wear clothes when she goes on holiday ??

I took a look at the feedback you left. Not quite the same wording I would have used myself, but it's your feedback to word as you like. I'm not sure but there may be a chance the seller could have it removed given the wording used, other posters here would know better than I if that might be the case.

 

 

 Whilst I certainly understand your anger at the seller I would like to make the following point though, for your future reference. When I review a sellers feedback and sift through the comments they were left for negs & neutrals to determine why they got them and how legit they appear to be, I find that I am more inclined to take the more dispassionate matter of fact comments much more seriously than the angry rant type comments. I'm not sure, but I think you may find that many others also view them in the same way as I do.

 

 That said, I hold my hand up as being in part responsible for the sentiment in your comments, as I was certainly encouraging you in leaving 'appropriate' feedback.

I am exhausted from reading all your comments, which is one sided and basically bullying. (Put yourself in my shoes finding this forum and seeing ppl say things about you.never have I experienced that)
seriously can't the buyer just move on.
She had raised 2 disputes with paypal (1st one as 'not received' then the 2nd one turned 'not Received' case switched to 'Significantly Not As Described' case) both declined on her side why because simply she received the goods as described with no faults. Because an item arrived after the intended use paypal made it clear that thats not a reason to approve a refund.
On lodging the follow up claim of 'significantly not as described' the buyer wrote:
"On 13/11 postman delivered goods. As no-one was home he left by the front door. My house sitter found the goods when he got home that night. He went to the post office to return to sender, but there is no senders address on the parcel. He contacted ebay but they only provided a name and phone number. He contacted paypal and they advised that as the goods had been received, they would not provide an address - they also would not give him information as he was not the account holder.When I finally reached port I phoned paypal, they said that as I had received goods, they could not refund"
so buyer lodged a false claim of 'items as not described' please tell me it was the right thing to do by the buyer.
PayPal declined with the status "The listing accurately described the item. We cannot grant claims based on buyer's remorse."

I have now got negative feedback on my account as truckiewoman01 decided to be remorseful. But you know what I just accepted it.

and for all of you that left posts thank you for not believing in my honestly when you don't know me.

Ps I just received an item that arrived 28 days AFTER the estimated delivery date. And you know what I didn't complain, didn't rase a dispute, didn't request for a charge back but I just realized thats the chance I take from buying from any internet buyer site.

Please no more comments. I have learnt from this transaction (I now know there are prepaid parcels and label things) and its unfortunate that one transaction out of 26 didn't go as buyer wanted.

Enough is enough.

Carly, you can appeal the feedback comments on the grounds that the buyer used the words lied and lies.  Ebay may not agee but you can try.

and also used the word "SCUM" . . . . . . which could be considered a profanity and therefore grounds for the neutral to be removed.  Unfortunately, as Carly has replied to the feedbacks, eBay might only replace the original feedback comment with "This comment has been removed by eBay" and leave the ratings (another reason to wait a while before leaving follow-up comments to feedback received).

Any feedback which includes words such as SCUM,LIAR,THIEF,UNDERSTANDING SELLER etc makes me think that a buyer may be a problem.Yes the term understanding seller means that they are a very slow payer or that the seller understood their problem & met their demands for refunds/partials or whatever else took buyer fancy to avoid a neg.

 

Serial negs left for a few sellers also puts that buyer on my BBL.

As a seller the OP has left fb for the buyer saying something about the buyer being patient so she has probably been a bit slow in posting items herself,

Since you didn't see slow post as a problem until now you probably didn't know about the Blocked Bidder List.I hope you have now found that under Site Preferences & add the OP & any others that you don't want to risk dealing with.I would have cancelled her bid in the blink of an eye if i had seen her fb left for others.

 

Yes you took too long posting but OP can still wear the clothes or sell them.The "i'm going on holiday & it has to be here by ..." is a bit overused i think.Sellers who post same day can have probs with postage issues too.Learn from this & move on.

paypal declined claim twice pretty much sais it all really as regards unfair expectations of this buyer.

Interesting when you read the OP's feedback as a seller. Here is just one example:

 

Doesn't seem to work, crushed in post due to flimsy packaging, 6 days to post...

 

When you read through them all and look at all the neutrals and negs, plus some positives, there are a few that mention slow postage, or not posted at all. 

 

The feedback left for others is also an interesting read. Seems to be a really unlucky buyer and very trigger happy. My guess is, there is a party list ahappenin' on the forums!

 

I'm glad Carly came back and gave an update on what's been going on behind the scenes. Proof that there is always 2 sides to every story! I would still suggest to Carly to increase her handling time to 7 days. Since I wrote that last message I have discovered that by changing from the quick listing tool to the advanced listing tool, the info does carry over, so it's just a matter of a few extra steps.

 

You can revise current listings that don't have bids to extend the handling time. Click revise on your listing, then up the top, click to change category. Up the top of the next screen is the link to switch to advanced listing tool. Ignore the warning and select switch. Next screen will show an empty box and above that is a link to your listing. Clicking on that will open your lising in the advanced tool. About 3/4 of the way down the page under the postage is the handling time. You can select anything up to 30 days. You can even put a visitor counter on your listings if you want to!

 

I am currently in the process of revising all my listings to extend the handling time. Using the advanced tool also allows the use of more item specifics and you can even add your own. You can even put a visitor counter on your listings if you want to!

 

Good luck Carly. I apologise if any of my previous comments were less than savoury. I think I got caught up in the mob mentality like some others did that have since backflipped. Don't worry about those funny colour dots. Buyers will see she was just being nasty.

Well, I still stand by what was said by myself and modestbods.

 

Regardless of the OP's fb history, she was treated shabbily with the seller taking 9 days to post her item.

 

Carly has a decently long history of being a buyer on ebay yet is totally ignorant of how the post system works.  Give me a break.

 

She absolutely should have accepted return of the items, just in the spirit of being a decent person.

 

Not even an apology

 

I hope Carly learns a bit of humility and lifts her game a bit.
