Seller wont cancel order but has already relisted it

Evening all

 

I put a bid in for an item that I won ($30 AUD). When I got the notification I had won I spoke to my daughter who I'd bought it for and she told me she already had got it from a friend. Please note sale ended at approx 1am and I notified them as soon as I saw the email at approx 7am so missed the one hour window to cancel an order due to sleeping.

 

I emailed the seller to ask if they would cancel the sale and explained the reason. The seller said they'd put in an unpaid strike in a couple of days. I again asked them if they could cancel the order a couple of days later (I have done this previously for someone, annoying I know but the same effort as an unpaid strike). I haven't heard back, buuuuut, they have relisted the item already...

Where do I go from here? It was a genuine mistake, I have 100% feedback as do they. Is there anything else I should do?

@elajayemn, when you wrote "I have done this previously for someone", you meant "I, as the seller in a past sale quite a while back, have done this previously for someone (i.e., cancelled the order for my buyer)", right?

 

If so, it does clear up the whole thing. You were expecting the same process in reverse - i.e., your seller (with you as the buyer) would, you hoped, cancel the order for you, just as you in the past cancelled an order upon your buyer's request where you were the seller.

A seller is charged fees as soon as an item sells.

In order to get their fees back many won't risk sending a cancellation in which you need to agree in case you click the wrong button.

So opening an unpaid means they are guaranteed of a fee credit and buyer cannot leave feedback after it's closed.

 

It won't affect your account if you only get one strike in 12 months, then it disappears.

 

No doubt seller has relisted it as you stated you won't pay.

 

Just let the seller close the unpaid when they can and that will be the end of it.

When you place a bid, eBay tell you that you're entering into a binding agreement.

 

In eBay's All about bidding page, they state:

 

❝When the listing ends, the highest bidder wins the item and completes the purchase. However, you should keep in mind that each bid you make is a binding contract to buy the item if you win.❞

 

On eBay's Non-binding bid policy page, they state:

 

❝In most product categories on eBay, when you place a bid in an auction it's considered binding – when you win an auction, you're agreeing to complete the sale.❞

 

Once you've won the item, you have no automatic right to expect the seller to cancel the sale. In many cases, it's not possible for the seller to cancel, particularly if notifications of winning bids are sent directly to the seller's packing department (or outsourced packing) and the item is already in the process of packaging and preparation for shipping.

 

There is no automatic self-cancellation of orders. I understand why you may think there is, but when you look at eBay's Cancelling an order page, you need to read the whole page, not just a snippet. I quote:

 

❝If you've changed your mind about an order, you can cancel it within an hour of your purchase, as long as the seller hasn't posted it yet.❞

 

Sellers are inconvenienced and potentially disadvantaged financially by cancellation requests. This is particularly the case if the seller has listed items during a promotion period where they incur no (or lower) listing fees or final value fees, and a buyer has come along and purchased, then the buyer shortly thereafter wants to cancel for "change of mind" reasons. The seller then has to go through the process of either cancelling (and hoping that the buyer will actually click onto the cancellation agreement, otherwise there's a frustrating wait since so many buyers simply don't bother clicking), or the Report Unpaid Item process being initiated. (In some cases the Report Unpaid Item is set up to proceed automatically if payment isn't received.) In some casees the item will only be relisted some months later if there's another promotion period. That means stock hanging around... Or there's the process of relisting, and possibly finding and unpacking the item to put it back into stock, and the paperwork involved. Other potential buyers have probably been lost, and some buyers are put off when they see a relisted item after seeing that it sold - and come here to post bitter complaints about how they suspect shill-bidding because "why would the item be relisted so quickly if it were legit?" ...

 

You've mentioned that you have 100% feedback. All buyers - including buyers from the bowels of hell itself - have 100% feedback, so that is really not relevant. You mention that you have previously changed your mind post-purchase, so I sense that you simply didn't realise all that may be involved, and how sellers often have a major focus on avoiding buyers who quickly change their minds and want to cancel once the purchase has already been made.

 

eBay have put in place the Unpaid Item Strike system to deter buyers from buying and then willy-nilly changing their minds and not paying to complete the transaction. I'm afraid you will simply have to wear the UPI, but don't worry - as long as you follow through with purchases in the future, it shouldn't affect you. If you do it again, it will probably affect your buying on eBay, as quite a lot of sellers set their Buyer Requirements to block bidders who haven't paid for 2 or more items in the last 12 months. Maybe check with the person for whom you're buying items before you place a bid...? Even after placing a bid, you can still withdraw your bid (although bear in mind that the valid reasons for bid retraction do not include "I found out that my daughter had received the same sort of item from a friend"). eBay say:

 

❝A bid is a binding contract that's active until an auction-style listing ends or you're outbid. You can only retract a bid if the seller significantly changed the description of the item or if you accidently bid the wrong amount. Retracting a bid for any other reason is considered an invalid bid retraction.❞

 

The best strategy really is to be sure before you place a bid that you'll complete the sale if you win.

As Kopes and Countess have said many buyers do not trust non-payers to do their side of a cancellation, so the seller has to wait longer than if they open a UPI case. Also sellers may have experienced non-payers in the past that do not agree to the cancellation and end up paying the fees anyway.

 

You've been a seller in the past, why not pay for the item and sell it yourself ?  Who knows you may even make a profit on it...........

You can only have 100% feedback as you have not sold anything in over a year

 

As mentioned, you have told the seller you are not going to pay, they have been charged money in fees

 

If this is the only time you are going to buy and not pay, one unpaid strike will not hurt you but the seller will get their fees back

We understand the seller not wanting to cancel, although we generally do.

We've noticed that this has changed a bit lately in that our fees were credited almost immediately for an item which had not been paid for rather than having to wait for the buyer to confirm.

They've probably jumped the gun a bit by re-listing the item straight away - you might decide to pay after all rather than accept an unpaid item strike.

In my opinion, you are being very unfair to the Seller. It was your mistake but you expect the Seller to put it right, no matter how inconvenient it is for them. In all fairness, I think you should go ahead and pay for the item and just resell it to someone else. You should make sure you want the item before you bid.  It is inexcusable to expect others to bear the brunt of your mistakes. Non-paying bidders are extremely unpopular with Sellers, there are no excuses that warrant it.  You may well find yourself on blocked lists after posting here.

I understand totally shoppingbag* It's something I've never done before and wouldn't usually but $$ is tight atm. I will just have to suck it up obviously, I wasn't sure what the process was besides having an order cancelled and now understand a bit more about unpaid strikes thanks to everyone's replies.
