WARNING: Manufacturer Warranty not valid when item purchased on eBay

Hi folks,

 

I have been just stung by something that I was unaware about manufacturer warranty.

 

I purchased 2 x Philips AirFlossers brand new and sealed in a box from an individual within Australia. He had very good feedback.

I received one correct model HX8211/06, and one wrong one (Older one HX8111). Long story short, I ended up having to go through a refund since the seller became unresponsive after I returned the incorrect item to him. So, I got my money back and I left negative feedback.

 

3 months later, the "good" item HX8211/06 stops working. On the Philips website, they offer 2 years warranty. I call Philips and they say that since the purchase has been made on eBay on a non-authorised reseller, my warranty is void and they will not honour it.

eBay and Paypal also refused to help since 3 months is past all their buyer protection timeframes.

 

Therefore guys - please check VERY CAREFULLY warranty terms when you buy something brand new on eBay.

Motor car manufacturers are wholly responsible for the 5 or 7 year warranties being offered and they are also transferable to the new owners. It really does depend upon the product but with more expensive items, it's the manufacturer who honours the warranty.

They can't when it comes to consumer guarantees, but a manufacturer's warranty is voluntary, and (generally) in addition to consumer guarantees, so can be conditional.

Well, that's fortuitous 😄 - can you be enticed to be the resident forum expert?  I've done retail and business training courses, all of which touched on this stuff, but much of the (course) content unfortunately was more of an overview, or ranged from insultingly remedial to not-quite-as insultingly remedial Smiley LOL, so there's lots of gaps in between what I know and what I can glean from the info on the website.

I bought an electronic item from a big name bricks and mortar store's eBay store. I received a tax invoice/receipt that was also for "warranty purposes".

 

The box had a freecall number on it for free in-home warranty repair. Couple of weeks shy of the end of the warranty, I had to call it. Polite and helpful customer service, same-day fix. Didn't even ask to see the receipt. So I would buy here from a reputable store's eBay listings again...I would read the listing of course 🙂

I bought an electric meat slicer from Kogan late Dec last year via their ebay site.

 

It was used maybe 3 times on leftover boneless beef roasts (still in original box when not in use) so no wear at all.

 

A month ago the spinning metal blade sheared off from a flimsy clear plastic hub that broke in use & the blade went flying across the kitchen at high speed. No one was hurt, but Kogan have ignored my emails & there is no warranty, despite the item being dangerous & not fit for its intended purpose. It seems I have no right of recourse via ebay or Kogan due to the elapsed time between purchase & fault finding. Had I used it more often the fault would have been found quicker!

 

Please do not buy this product from Kogan! It appears they no longer sell it on ebay since my complaint; But it is still available on their website.

There is no time limit on reporting dangerous goods to Consumer Affairs.

WRONG! (and Ebay and the manufacturer know it).

 

Under Australian consumer law a product "Must be fit for purpose" and must continue to work for a reasonable amount of time, REGARDLESS OF HOW OR WHERE IT WAS PURCHASED.

Phillips are just bull**bleep**ting you, they manufactured the faulty product and it is their problem.

Just tell them you will get legal advice and then take it to the Ombudsman, they will soon change their mind.

And if they don't you can actually lodge a complaint.

 

I haven't bought Phillips products in years as I found them to be extremly ureliable, and sercice non existant.

the member you replied to is unlikely to see your post as they haven’t logged into these boards for over two years. They started this thread more than 4 years ago.

 

Can you post links to the section of Australian Consumer Law that deals with warranty on non-authorised resellers and online platforms?  I’d be grateful as I will take screengrabs of the relevant sections of the law for future reference.

I hate Kogan.  We bought a TV from there. When it arrived there were dead pixels on the screen, the remote packaging had obviously been opened (must have been a return) and they tried to refuse a return stating they won’t accept a return for less than xx dead pixels to which I replied, I didn’t purchase a TV with dead pixels, I purchased a brand new TV. After back and forth, they finally agreed to accept the return although left us $50 out of pocket for courier costs. Never purchased from them again!
