Have to wait 2 months before i can report a seller for no item recieved

Paid for a Item on the 15th Sept and have still not recieved it .Now i am told by Ebay that i Can't report it untill after the 7th Nov.So it is pretty stupid rule that you have to wait two months to try and get a refund from a seller.

I have just been charged 10% for GST on items AND postage from Germany. As far as I understood the GST was to be only on items purchased. This will cut down my overseas purchases greatly.
