Complaint about <Removed> seller--BEWARE of this seller--On 10/10/2010 I purchased a brushcutter from this seller. Unknown to me at the time was the fact that this seller was selling goods on EBay which they did not have in stock! After waiting 3-4 weeks after paying for the brushcutter, they finally answered my emails and advised that they were awaiting stock. I then made a complaint to EBay about this buyer selling goods which they did not have and after investigation by EBay, my brushcutter finally arrived some 6 weeks after my purchase. <Removed> did send me a $25 cheque "in consideration of the delay with your brushcutter" I was happy with the brushcutter. Recently, the pull starter on the brushcutter broke and I then contacted <Removed> through EBay for a replacement pull starter assembly, on the 9/6/2014. Before they would assist me , they requested that I provide them with--1) date of purchase, 2) full delivery name, 3) full delivery address, 4)EBay user name, and 5) telephone number. I provided all the requested information on 10/6/2014, as well as a photo of the pull starter assembly. <Removed>then started "playing games with me, stating that they never recieved the photo, even though it was attached to my email to them. I resent the photo to them another 2 times. They replied that they had forwarded the matter onto their spare parts section and were awaiting a reply.On 12/6/2014 I again emailed <Removed> requesting a reply, however they have ignored my email to date. I feel that <Removed>have "played games" with me as I put in a complaint about them 4 years ago!!! I find their behaviour very unethical and just plain childish. EBay does not need these types of sellers and they are hurting the reputation of EBay. Could you please look into this matter. Thanking you, Graham Carpenter.

Hi Narelle, you must be fairly mature if you still remember what John McEnroe said!! Unfortunately, you have made several incorrect assumptions--please read my reply to "grumpy*cat*rocks" but just quickly, I wanted to BUY, yes BUY a spare part, at no time did I expect the part to be replaced under warranty. It's a pity that you're not mature enough to stop name calling, especially when you are not in pocession of ALL the FACTS. Graham.

You, like the other posters have made a wrong assumption, I enquired to the availability and COST of a part--I did not expect or ever request a part under warranty--I did however make a mistake in posting on EBays' forum, I thought that I was making a complaint to EBay--that was my mistake/inexperience with EBay systems--I still stand by my comments about this seller--they still have not given me an answer to my enquiry! Nowhere in your original post does it state that you offered to buy the part, just that you requested one. It's pretty easy to make assumptions when you don't have all of the information so you could hardly blame the board members for not knowing something you didn't divulge in your original post...
Even so, the seller is still under no obligation to send you a replacement part. You really should have saved your energy and just bought the part from a hardware store.

Regarding 2 - you're right, a seller is not supposed to list an item for sale if it is not in stock, often the situation occurs unintentionally, but either way I think most would agree that they supplied you with the item you paid for, plus compensated you for the delay, so there is nothing for eBay to investigate on that point - that transaction is done and dusted.
Regarding 3 - if all you asked the seller was whether they could supply the spare part and what it would cost, I see no reason for the following response you said the seller made:
"Before they would assist me , they requested that I provide them with--1) date of purchase, 2) full delivery name, 3) full delivery address, 4)EBay user name, and 5) telephone number."
The previous transaction must have been mentioned in relation to your enquiry, in one way or another. Did you ever use your credit and perhaps wish it to still be honoured? Even if so, most offers like that have a time limit ranging between 1-12months (usually express, as in stated explicitly, not sure if there is any kind of standard 'implied' limitation if there is not one stated), and again, there really isn't anything here for eBay to investigate, because they have no jurisdiction over private arrangements between a buyer and seller, and ultimately a seller is not obliged to sell to you. If you feel they are being unprofessional and disrespectful, the best thing you can do is deal with someone else.

I have the benefit of coming to this thread at this point and seeing your clarification.
I can't know whether or not your supplier is playing games. I can let you know there have been several reports on the forum (these boards) about the message system not working properly (indeed since the whole time I've been a member!) but more pronounced this year.
If you are still interested in dealing with this supplier do they have an Australian phone number you could ring just in case the messages are being sent to oblivion?
I hope you get everything sorted out and can source a new part soon. Good luck!

Hi gnomes, welcome to the ebay forums, the advice given here is generally very good but you need to wear your thick skin and give all facts or some may jump to conclusions.
Regarding the chinese brush cutter you will probably find there are no spares available anywhere. In fact the factory may no longer even exist, we have the same problem in my industry. Sadly the general public is being wooed by the cheap items from Asia only to find down the track that once it's broken that's it, bin it.

I didn't know that "I then contacted <Removed> through EBay for a replacement pull starter assembly" meant "I enquired to the availability and COST of a part". Once agin, my mistake!
