Hello everyone.

How can I get refund?

 

The status in the ebay system shows Delivered, but far late after expected time frame and if you look the tracking history after "Delivery" statement it continues and end up with "Returned to Sender"

 

I bought and paid an item.

The auction was clearly written " Delivery: Estimated within 4-8 business days". The email I got also have Estimated delivery time frame.

But seller shipped the item on the last day of the written time frame.

Very long after all time frames the item arrived on the address and was immediately Returned to Sender because the address is not actual any more. No one have signed that "Delivery", package just have been returned to sender

 

However, ebay page shows Delivered but if you open the tracking history after the record Delivered, tracking continues with Returned to Sender in few more records showing that

 

Now the seller have both, the item and the money and refusing refund.

I opened ebay case "Item not received" to get refund . The seller refuse and no communication. If I escalate the case will I get refund? What can I do to get refund?

will you get a refund.............probably not if the seller can prove delivery.

 

Also ebays estimates are just that, ebay's estimates. they are not australia post and cannot be certain of the delivery time frame so you shouldn't be holding your sellers to that time frame.

 

So many things that have question marks around them in this story.

Did you change your address after you bought the item?  That is the way I read your comment "address is not actual any more".

 

The seller cannot be blamed if you have left the address and not made arrangements to collect any mail that may arrive after you left.

 

It would not have been returned to the sender immediately...it would have been held at the post office for 10 days.

 

Have you asked the seller if he will resend the item if you pay postage again?

@harley_babes_hoard So you saying that when address is not valid any more, because seller breached ebay's policy of 3 business days shipping, the seller have rights to keep the item and money, right? Do you know how is calling this? Doesn't look theft?

So the sellers have rights to ship items out of any promised time frames?

I'm pretty sure there is strict shipment policy in ebay,  3 business days (if not stated something else) and that policy is breached too in this case!

The delivery is not actual, since late shipping breach ebay policy -3 business days, the address is not actual anymore and that is why AusPost perform Return To Sender

What was the seller's exact handling time?

please point me in the direction of ebays policy regarding three day shipping?

Because from where I stand sellers can choose there own shipping rules. Like 1 3 or 5 days handling times. The seller has shipped it to the address that was obviously given to them it's not the sellers fault if the buyer has moved and can no longer claim the item.

 

I never said it was ok for the buyer to keep the item and the money, don't make things up.

 

Yes please post a item number so we can at least see what the sellers posting terms were. I was simply saying that the expected delivery dates that ebay give are just that estimates, I didn't actual mention shipping timeframes

Nope, Auspost can held 10 days for collection. Term collection is when the address is Ok and the package is deliverable, just a matter of time to be collected.

But this is not the case, because the package is not deliverable and according AusPost laws they do Return to Sender. And it is done on the same day, no 10 days collection wait and that's how is returned immediately.

According Australia Postal Industry law:

Where a former occupant has left an address and does not have a redirection or hold in place, their mail will generally continue to be delivered to their former address. The current occupant should mark the front of the article as 'return to sender' and 'no longer at this address' and, optionally, 'please update your records', and re-post it to the sender. Mail must not be opened. There is no fee for returning to sender unopened articles.

 

The seller break ebay's 3 business days rule for shipping. It arrived late of any promised time frames and was returned to sender immediately.

Do you think I have rights?

Or the seller keeps the item and my money is just fine? I don't see any delivery here aren't you?

My new address would need a huge postage fee so I wouldn't buy from that seller

they are not promised time frames at all, they are simply estimates and not from australia post.

You obviously (think you) know your rights so why are you asking for advice?

 

Nowhere does it say that the seller must post within 3 days....what was the seller's stated handling time?

 

You have also hit the nail on the head.....the item can be returned to sender if the recipient has left the address without arranging to collect his mail or have it forwarded.   You have admitted that the address is incorrect.

 

Again I ask.....will the sender post again if you pay the postage and provide your correct address.

Just to clarify- It was sent to the adress on the ebay transaction but the buyer no longer lived there and had not made arrangements made to redirect their mail?

 

The buyer is at fault and needs to offer to pay postage again to the right adress. Seller cannot be held responsible and nit picking ebay made up fantasy postage timeframes is no excuse.
