So I sold an item advertised for local pick up, out of state buyer sent courier to collect and the item arrived with him damaged . Buyer asks for a return , although also advertised as returns not accepted .
I packed the item well , i supplied the box and packaging at no cost to him because I had some good boxes around .
EBay have now been asked to step in , which personally I think is best .
After a conversation this morning on live chat , a person called Kelly agread that he cannot expect me to pay for the items return .
How's this going to go ?

BTW - eBay could argue that "not collected by the buyer" is for situations where the buyer fails completely to pick up the item, meaning the seller retains possession of it. That line is just vague enough to be equally applicable in both scenarios.
But, if you have lots of evidence (photos) of the item, you may have a stronger case for "items damaged during pick-up or delivery".
Or both. If you can convince eBay the buyer is ineligible to claim under two criteria, all the more better.

The listing photos would still help, if you still have those. The main thing you want to convey is that item was undamaged at point of sale, and besides which the MBG says buyers aren't covered for items damaged during pick-up / delivery, and / or where they don't collect the item.
Then ask them to explain why they are entertaining a claim for a buyer who does not meet the stated eligibility requirements.

I just looked at the listing for the first time.
A pre-owned home theatre system, sold with a 6 word description that says
'As new bar a few scuffs' and using one single stock photo.
No photos of the actual item.

A local buyer , which was whom I was looking for would of come around , had a full viewing and a demo of the item , saw it as described and been happy with it I'm sure .
I should of stuck to my guns and refused shipping . That's where I went wrong .
Not to worry , we'll see how it goes and I'm in contact with the courier myself ... awaiting a response .
Thanks for everyones input

@hotchopper77
Mate, you've been stringing us along!
as new bar a few scuffs is a **bleep**py/**bleep**/woeful lacking description of the item, and it actually indicates that it has scratches (one man's scuffs is another mans scratches)
Unfortunaltely for the buyer, he isnt protected under the MBG or INAD but I reckon eBay may just give it to him, due to your lack of description and conditioin of the item you sold.
eBay can do anything... they're eBay!
WHY have you used a stock photo?
WHY didnt you take photos of the *scuffs* and add them to your blurb as a description? (eg: a few scuffs as shown in photo 2)
I hope this is a learning tool for you for future listings........
best of luck with it all.
at eBay bleeping all my describing words LOL
