Buyer in UK refunded even though item delivered.

It's happened to me now.I have read that this is happening to other sellers.A case was opened with buyer saying he hadnt recieved item..I reported the tracking number and item was delivered on Monday...I tried contacting the buyer asking him to cancel the complaint..Now Ebay has refunded him even though the item was delivered  on Mondayas per Australian post tracking...I have tried lodging an appeal but when I try it says that the item is not available to appeal on..So where do I go.I have asked buyer to contact Ebay or at least return item.But no answer.

Very weird.....you can't owe both ebay and paypal unless they both paid out on the claim....and a buyer cannot have an ebay and a paypal claim open at the same time.

Also if the payment was made using paypal, ring paypal to complain as you may be covered by paypal seller protection if tracking shows the item as having been delivered.

If you get nowhere talking to paypal then file a complaint against them with the FOS.

 have done all the things suggested..They wont do anything.Both Ebay Australia and Ebay UK have said tough luck  more or less.Telling me to contact the buyer,Who is unresponsive,He was obviously planning to do this .Tracking was sent to him when I posted and to Ebay.They reckon they didnt recieve it,,,Item definatly showed delivered last Monday and they refunded on Wednesday..They just keep sending me things saying I owe the money to them..I have some friends in England might try getting him charged with fraud.Thats what it is.

I think I would be going to the Financial Services Ombudsman before looking at legal action in another country.

It is not possible to owe money to both paypal and ebay for the same transaction.

I'd be inclined to persist, continually pointing out that the decision to refund was an eBay decision, made days after the tracking showed delivered, and that legal options will be explored if they do not rectify their error.

To my way of thinking, you need to get them in a position where they need to defend that decision, which they can't (realistically and / or acceptably) do, which may prompt a "discretionary" credit (the kind where they try to make you feel grateful for their generosity).
